Johnson, Trustee <br />to Manor Village, LLC by Deed of Gift dated October 21, 2014 and recorded in the <br />Portsmouth Circuit Court Clerk’s Office as Instrument Number 140009898. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) No more than four (4) trucks shall be parked on the 6229 Portsmouth Boulevard <br />property at any given time in conjunction with the use. <br /> <br />(b) The use shall be confined to Suite 6229 of the 6229 Portsmouth Boulevard <br />property. <br /> <br />(c) The use shall be operated in compliance with the following use-specific standard <br />in accordance with Section 40.2-217(G)(7)(a) of the Zoning Ordinance: <br /> <br />(i) All newly established new and used vehicle sales uses shall be prohibited from <br />parking or displaying vehicles in the required buffer between the front lot line and any <br />vehicle use area. <br /> <br />(d) Prior to commencing the use, a Zoning Permit must be obtained from the City’s <br />Zoning Administrator and a Certificate of Occupancy must be obtained from the <br />Department of Permits and Inspections. <br /> <br />(e) The maximum occupancy load, including patrons and employees, shall comply <br />with the limits set by the Building Official. <br /> <br />(f) All required local, state, and federal licenses and permits must be obtained prior <br />to commencement of the use and must be maintained in effect during the operation of the <br />use. <br /> <br />(g) All taxes/fees associated with the property or the use shall be paid when due, as <br />determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. The properties are forested and vacant of structures. <br />The proposed development is an expansion of the neighboring <br />Ansell Gardens Apartments. The combined properties are <br />approximately 2.26 acres in size and will be developed at a density <br />of 18 units per acre. The Generalized Future Land Use Map of the <br />Build One Portsmouth Comprehensive Plan recommends Low to <br />Medium Density Single-Family Residential Development for both <br />properties.
