October 12, 2021 <br /> <br />(a) The development shall maintain parking in accordance with the off-site alternative <br />parking plan titled “Washington Street LLC Alternative Parking Plan”, as well as the <br />written agreement titled “Real Estate Lease” effective August 1, 2021 between <br />Monumental United Methodist Church and Edward O’Brien, each of which is on file with <br />the Planning Department. Any amendment to the alternative parking plan or the Real <br />Estate Lease shall be submitted to the City’s Zoning Administrator for review and approval <br />to confirm continued satisfaction of the requirements of this use permit and the Zoning <br />Ordinance. <br /> <br />(b) Without limitation, the development shall maintain compliance with the following <br />use-specific standards in accordance with Section 40.2-217(G)(4)(b) of the Zoning <br />Ordinance: <br />(i) Entertainment establishments shall not create unreasonable environmental aspects <br />such as noise, odor, smoke, vibration, heat, or glare. <br />(ii) Noise from the establishment shall comply with Section 24-255 of the City Code <br />(Unlawful Excessive Sound). <br />(iii) Any building housing live entertainment shall include soundproof entryway and exit <br />doors. <br /> <br />(c) Where required by the Zoning Ordinance, all external site and building <br />improvements, including signage, must be approved through issuance of a Certificate of <br />Appropriateness by the Historic Preservation Commission prior to the commencement of <br />work. <br /> <br />(d) Without limitation, prior to commencing operation of the entertainment <br />establishment: (i) a new Zoning Permit must be obtained from the Zoning Administrator; <br />and (ii) a Certificate of Occupancy must be obtained from the Department of Permits and <br />Inspections. <br /> <br />(e) The maximum occupancy load of the entertainment establishment, including <br />patrons and employees, shall be in compliance with any limits set by the Building Official. <br /> <br />(f) No events or live entertainment shall occur at the entertainment establishment on <br />any Sunday. <br /> <br />(g) All local, state and federal licenses and permits required for operation of the <br />entertainment establishment shall be obtained and maintained in good standing. <br /> <br />(h) All taxes/fees associated with the property shall be paid when due, as determined <br />by the City Treasurer. <br /> <br />(i) The owners and/or operators of the entertainment establishment shall not violate <br />any laws of the Commonwealth or ordinances of the City related to peace and good order, <br />nor suffer repeated or chronic violations by any patrons or customers. If the Chief of <br />Police, in his or her discretion, determines that there are significant violations of this type <br />so as to comprise a significant law enforcement problem, he or she shall notify the <br />applicant in writing and shall provide a copy of such notice to the Zoning Administrator, <br />which may result in the initiation of proceedings for the revocation of this use permit. <br /> <br />REVOCATION OF PERMIT: <br />7.
