<br />At a Called Meeting of the City Council on Tuesday, September 28, 2021, there
<br />were present:
<br />
<br />Vice Mayor De’Andre A. Barnes, William E. Moody, Jr., Lisa L. Lucas-Burke, Dr. Mark M.
<br />Whitaker, Paul J. Battle, Christopher L. Woodard, Jr., City Manager Angel L. Jones,
<br />Interim City Attorney Burle U. Stromberg.
<br />
<br />21 - 284 - Vice Mayor Barnes called the meeting to order and welcomed all in attendance.
<br />
<br /> " Please attend a called meeting of the City Council to be held in the City Council
<br />Chamber, 801 Crawford Street, 5:00 p.m., Tuesday, September 28, 2021, for the purpose
<br />of a Public Work Session.
<br />
<br /> In addition, you may consider a motion to go into a Closed Meeting.
<br />
<br />By order of the Mayor."
<br />
<br />21 - 285 - The following items were discussed in Public Work Session:
<br />
<br />1. Historic Preservation Commission (HPC) Appeal - 2601 Bayview Blvd.
<br />
<br /> Motion by Dr. Whitaker, and seconded by Ms. Lucas-Burke, to approve an after
<br />the fact request to remove exterior wooden porch handrails and replace at 2601Bayview
<br />Boulevard, and was adopted by the following vote:
<br />
<br />Ayes: Battle, Lucas-Burke, Whitaker, Woodard, Barnes
<br />Nays: Moody
<br />
<br />2. American Rescue Plan Act (ARPA) - Mimi Terry, Deputy City Manager
<br />
<br />-Councilman Moody asked that staff comeback with a comparison of the impact of
<br />the cost of living for those with an income of $30,000 in 1988 and 2021. He also
<br />asked that businesses be required to be current on their taxes before receiving
<br />ARPA funds.
<br />
<br />-Councilman Whitaker asked that staff come back with the proposed amounts for
<br />direct payments, how many citizens would be affected, and the qualifications.
<br />
<br />
<br /> There was a consensus of City Council to allow for one-on-one sessions with
<br />City Manager Jones, Deputy City Manager Terry and City Council members to
<br />discuss ARPA funds.
<br />
<br />21 - 286 - Motion by Ms. Lucas-Burke, and seconded by Dr. Whitaker, to go into a closed
<br />meeting pursuant to Virginia Code subsection 2.2-3711 A.7 for the purpose of
<br />consultation with legal counsel pertaining to actual or probable litigation, where such
<br />consultation in open meeting would adversely affect the negotiating or litigating posture
<br />of the City, specifically regarding events related to the Monument protests.
<br />
<br />The motion was adopted by the following vote:
<br />
<br />Ayes: Battle, Lucas-Burke, Moody, Whitaker, Woodard, Barnes
<br />Nays: None
<br />
<br />Motion Ms. Lucas-Burke, and seconded by Mr. Moody, pursuant to Virginia Code
<br />Section 2.2-3712(D) certifying that, to the best of the Council Members’ knowledge:
<br />
<br />1. Only public business matters lawfully exempted from open meeting
<br />requirements under the Virginia Freedom of Information Act, and
<br />
<br />2. Only such public business matters as were identified in the motion by which the
<br />Closed Meeting was convened were heard, discussed, or considered in the
<br />closed meeting just concluded by the City Council.
