August 10, 2021 <br /> <br />ALL THOSE certain lots or parcels of land, with the buildings and improvements thereon, <br />situate, lying and being in the City of Portsmouth, State of Virginia, numbered and <br />designated as Lots 17, 18, 19, 20, 21 and 22, in Block 56, as shown on that certain plat <br />entitled, “PLAT OF PRENTIS PARK”, said plat is duly recorded in the Clerk’s Office of the <br />Circuit Court of the City of Chesapeake, Virginia, in Map Book 13, at page 5. <br /> <br />IT BEING all of that certain property conveyed by Deed of Correction from Prolific <br />Properties, LLC to W.I.N. Property Management and Realestate Developement, Limited <br />dated October 25, 2018 and recorded in the Portsmouth Circuit Court Clerk’s Office as <br />Instrument Number 180012198. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the concept plan entitled <br />Conceptual Development Layout prepared by AEK Construction dated May 2021 and the <br />rendered concept elevations prepared by AEK Construction received June 22, 2021, <br />except where modifications may be required to comply with all applicable local, state, and <br />federal codes and regulations. <br /> <br />(b) Townhouse dwelling lots shall be subdivided in accordance with Chapter 33.1 of <br />the City Code (Subdivision Ordinance) prior to obtaining site plan approval. <br /> <br />(c) At no cost to the City, the applicant shall extend the Nashville Avenue right-of-way <br />to accommodate the driveways of the last two units in accordance with Section 33.1-43 <br />of the City Code. <br /> <br />(d) The development shall be constructed in compliance with all applicable codes, <br />ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained and remain in effect during the operation of the <br />development. <br /> <br />(e) All taxes/fees associated with the property and/or the proposed use must be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />CROSS CREEK APARTMENTS <br />(c) UP-21-11 - Resolution granting the request <br />of Community Housing Partners Corporation for a Use Permit at <br />2519 and 2521 Bird Lane to develop 71 apartment units and a <br />leasing office on the combined properties. The parcel at 2519 Bird <br />Lane contains 24 apartment units of which would be demolished. <br />The combined properties are approximately 7.04 acres in size and <br />will be developed at a density of 10 dwelling units per acre. The <br />properties are further described as Tax Map 454, Parcels 2 and 5. <br />The Generalized Future Land Use Map of the Build One <br />Portsmouth Comprehensive Plan recommends Multifamily <br />Residential Development for both properties. <br /> <br />1.
