June 22, 2021 <br /> <br />LESS, SAVE AND EXCEPT that portion of the subject property consisting of Lots 9 and <br />11 as shown on that certain plat entitled “Seaboard Airline Railroad, Portsmouth, Virginia”, <br />which was conveyed to High Meadow Holdings, LLC by deed dated June 21, 2005 and <br />duly recorded as Instrument Number 050002832 and corrected as Instrument Number <br />050014920. <br /> <br />IT BEING all that certain property conveyed to Economic Development Authority of the <br />City of Portsmouth, Virginia by Deed of Bargain and Sale from Ten River Lots, LLC dated <br />August 15, 2016 and recorded in the Portsmouth Circuit Court Clerk’s Office as <br />Instrument Number 160008062. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the concept plan entitled <br />A4 Landing at High Street prepared by Hoggard-Eure Associates, PC dated March 19, <br />2021 and the rendered concept elevations titled High Street Townhomes prepared by <br />Retnauer Baynes Associates, LLC dated March 19, 2021, except where modifications <br />may be required to comply with all applicable local, state, and federal codes and <br />regulations. <br /> <br />(b) Townhouse dwelling lots shall be subdivided in accordance with Chapter 33.1 of <br />the City Code (Subdivision Ordinance) prior to obtaining building permits. <br /> <br />(c) The development shall include streetscape improvements along all street <br />frontages, including those consistent with the current High Street Corridor Multimodal <br />Concept Plan, subject to any deviations approved by the City Engineer. <br /> <br />(d) The development shall be constructed in compliance with all applicable codes, <br />ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained and remain in effect during the operation of the <br />development. <br /> <br />(e) All taxes/fees associated with the property and/or the proposed use must be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />21 - 169c: <br /> <br />“ORDINANCE TO AMEND AND REORDAIN CHAPTER 40.2 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (ZONING ORDINANCE) BY MODIFYING <br />SECTIONS 40.2-307, 40.2-533, AND 40.2-535 AND TABLE 40.2-301 FOR THE <br />PURPOSE OF MODIFYING REQUIREMENTS RELATED TO OUTDOOR <br />ADVERTISING SIGNS, OFF-PREMISES SIGNS, NONCONFORMING SIGNS, <br />FREESTANDING PERMANENT SIGNS, CHANGEABLE COPY, AND OFF-STREET <br />PARKING STANDARDS FOR MULTI-FAMILY DWELLINGS.” <br /> <br />21 - 169d: <br /> <br />“ORDINANCE TO AMEND AND REORDAIN CHAPTER 40.2 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (ZONING ORDINANCE) BY MODIFYING <br />SECTION 40.2-532 (ZONING TEXT AND ZONING MAP AMENDMENTS) AND <br />SECTION 40.2-533 (USE PERMITS) FOR THE PURPOSE OF ELIMINATING THE <br />REQUIREMENT FOR A SECOND READING ON APPROVED ZONING ITEMS.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
