May 25, 2021 <br /> <br />(b) Prior to commencement of the use, the owner and its successors and assigns <br />shall: <br /> <br /> i. Cause a “NO PARKING HERE TO CORNER” sign to be affixed an appropriate <br />distance from the corner of Lincoln Street and Elm Avenue to allow sufficient space for <br />vehicle turns onto the Elm Avenue right-of-way. <br /> <br /> ii. Replace broken, damaged or missing sidewalk and curbing that abuts 1819 Elm <br />Avenue. <br /> <br /> iii. Install striping to create three (3) on-street parallel parking spaces capable of <br />serving the use, each having dimensions of not less than 8’ x 22’. <br /> <br />(c) A sign permit must be obtained prior to the establishment of any new signage on <br />the property. <br /> <br />(d) The development must include a dumpster that complies with all relevant state and <br />local codes, including without limitation Portsmouth City Code Section 40.2-304(F)(5), <br />and including without limitation surfacing, setback, and screening requirements. <br /> <br />(e) All required inspections must be performed by, and any required Certificate of <br />Occupancy obtained from, the City Department of Permits and Inspections prior to <br />commencement of the operation of the approved use. <br /> <br />(f) All required federal, state and/or local permits must be obtained prior to <br />commencement of the approved use and maintained at all times during continuation of <br />the use, and the use must be conducted in compliance with all applicable codes, <br />ordinances, and regulations of federal, state and local government. <br /> <br />(g) The existing nature and location of landscaping on the property, including <br />shrubbery and mature tree canopy, shall be substantially maintained. <br /> <br />(h) All taxes/fees associated with the property and/or the proposed use must be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Battle, Moody, Whitaker, Woodard, Glover <br />Nays: None <br />Abstain: Lucas-Burke (property owner) <br /> <br /> Motion by Mr. Woodard, and seconded by Mr. Barnes, to adopt the following <br />resolution approved on first reading at the May 11, 2021 meeting, and was adopted by <br />the following vote: <br /> <br />21-140b: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-21-05) TO JRF SHIP REPAIRS, LLC <br />TO OPERATE A LIGHT MANUFACTURING BUSINESS CONSISTING OF A METAL <br />FABRICATION SHOP AND WAREHOUSE AT 3409 GEORGE WASHINGTON <br />HIGHWAY (TAX PARCEL 0385-0030). <br /> <br /> <br />WHEREAS <br /> , Wayne Cummins, the authorized agent for JRF Ship Repairs, LLC, <br />the contract purchaser or lessee of the subject property, has made application pursuant <br />to Section 40.2-533 of the Code of the City of Portsmouth, Virginia for the granting of a <br />use permit to operate a light manufacturing business consisting of a metal fabrication <br />shop and warehouse at 3409 George Washington Highway, Tax Parcel 0385-0030; and <br /> <br />WHEREAS, <br /> 3409 GWH/P LLC, the owner of the subject property, has consented <br />to the application; and <br /> <br /> <br /> <br /> <br /> <br />
