May 25, 2021 <br /> <br />At a Virtual Meeting of the City Council on Tuesday, May 25, 2021, there were <br />present: <br /> <br />Mayor Shannon E. Glover, Vice Mayor De’Andre A. Barnes, William E. Moody, Jr., Lisa <br />L. Lucas-Burke, Dr. Mark M. Whitaker, Paul J. Battle, Christopher L. Woodard, Jr., City <br />Manager Angel L. Jones, Interim City Attorney Burle U. Stromberg. <br /> <br /> Mayor Glover called the meeting to order and welcomed all in attendance. <br /> <br /> Mayor Glover made the following statement: <br /> <br /> <br />“In accordance with Governor Ralph Northam’s Declaration of a State of Emergency due <br />to novel coronavirus (Executive Order 51) on March 12, 2020 and the Local Declaration <br />of Emergency ratified by the Portsmouth City Council; and due to the coronavirus <br />pandemic which is continuing in the Commonwealth of Virginia, this meeting of the <br />th <br />Portsmouth City Council is being held by video conference on the 25 day of May, 2021 <br />without a quorum present in the City Council Chamber in order to reduce the likely spread <br />of the coronavirus. Each city council member is participating from their home and I am in <br />the City Council Chamber. This meeting is being held in accordance with Portsmouth City <br />Ordinance 2020-102.” <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Barnes, to adopt the minutes of a <br />Virtual Called Meeting of May 11, 2021, and of a Virtual Meeting of May 11, 2021, and <br />was adopted by the following vote: <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />- Public Hearing - <br /> <br /> <br />21-152Public hearing on the FY 2021-2022 Annual Action Plan. <br /> <br />- Unfinished Business - <br /> <br />21 - 129 - Adoption of an ordinance to amend and reordain Division 1 of Article V <br />of Chapter 12 of the Code of the City of Portsmouth, Virginia (Public Procurement; <br />Program to Facilitate Participation in Procurement Transactions by Small <br />Businesses and Businesses Owned by Women and Minorities) by making several <br />amendments to Section 12-176 and to amend and reordain Article V of Chapter 2 <br />of the Code of the City of Portsmouth, Virginia (City Manager) by adding a new <br />Section 2-168 regarding minority participation in business and economic <br />development programs. Deferred from the April 27, 2021 City Council meeting. <br /> <br />Background: <br /> <br /> <br /> By consensus at its meeting on March 23, 2021, City Council requested the <br /> <br />preparation of these proposed amendments to the City Code. <br /> <br /> Section 12-176 of the Code establishes the City’s program to facilitate participation <br />in procurement transactions by small businesses and businesses owned by women and <br /> <br />minorities. <br /> <br /> The current Code places responsibility for the establishment of the program with <br /> <br />the purchasing administrator rather than the city manager. <br /> <br /> In addition, Section 12-176 is intended to be a remedial provision to address <br />disparities in the usage of minority- and women-owned businesses that have been <br />documented through the City’s Disparity Study. However, Section 12-176 also includes <br />provisions to benefit small businesses and businesses owned by disabled veterans; the <br />existing Disparity Study does not document disparities in the usage of these categories <br /> <br />of businesses. <br /> <br /> Finally, the current Code addresses minority participation in procurement <br />transactions, but does address business development and economic development <br /> <br />programs. <br /> <br /> <br /> <br /> <br /> <br /> <br />
