February 23, 2021 <br /> <br /> WHEREAS, <br />by Resolution R-20-09 adopted on February 25, 2020, the Council <br />of the City of Portsmouth, Virginia adopted a Local Revenue Allocation Policy for the <br />purpose of establishing a formula governing the annual allocation of local revenue to <br />Portsmouth Public Schools; and <br /> <br />WHEREAS, <br /> City Council desires to rescind the Local Revenue Allocation Policy; <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it hereby rescinds the Local Revenue Allocation Policy, and said <br />Policy shall be of no further force or effect; and <br /> <br />2. That this Resolution shall take effect on the date of its adoption.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Whitaker, Woodard, Glover <br />Nays: Moody <br /> <br />b. Adoption of an ordinance confirming and continuing Ordinance 2020-102 <br />adopted on October 13, 2020 and the emergency procedures established thereunder to <br />ensure the continuity of local government during the COVID-19 pandemic. <br /> <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, asked that City Council reevaluate how <br /> citizens participate in the meetings. <br /> <br /> There was a consensus of City Council to direct the Information Technology <br /> <br />department to take the necessary steps that would enable citizens to be on-screen <br />during the Council meetings. <br /> <br />Motion by Dr. Whitaker, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE CONFIRMING AND CONTINUING ORDINANCE 2020-102 ADOPTED <br />ON OCTOBER 13, 2020 AND THE EMERGENCY PROCEDURES ESTABLISHED <br />THEREUNDER TO ENSURE THE CONTINUITY OF LOCAL GOVERNMENT DURING <br />THE COVID-19 PANDEMIC.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br /> Councilman Whitaker read the following statement: <br /> <br /> <br /> “Pursuant to Virginia Code subsection 2.2-3712(b), within 15 days of this notice <br />City Council intends to conduct closed meetings at an undisclosed location or <br />electronically for the purpose of interviewing candidates for the position of City Manager. <br />Should the need arise to conduct additional closed meetings for the same purpose after <br />the 15 day period ends, City Council will re-issue this notice.” <br /> <br />21 - 80 - Report on Pending Items <br /> <br /> Dr. Whitaker asked Interim City Attorney Stromberg on the timeline in which he would <br /> <br />be responding to the following request that was presented at a previous meeting: <br /> <br />-VA Code Section 15.2-965.1 - <br /> <br /> Changing the code to be applied in a broader manner for the City Manager to <br />use not only in procurement but in any operations of the City. <br /> <br />-VA Code Section 12.176 - <br /> <br /> Changing the language “purchasing administrator” to City Manager or designee <br />of the City Manager. <br /> <br /> If it’s legal for City Council to change the definition of small business. <br /> <br /> <br /> Interim City Attorney Stromberg informed citizens and City Council that he would <br />provide that information before the next Council meeting. <br /> <br /> <br /> <br /> <br />
