February 23, 2021 WHEREAS, by Resolution R-20-09 adopted on February 25, 2020, the Council of the City of Portsmouth, Virginia adopted a Local Revenue Allocation Policy for the purpose of establishing a formula governing the annual allocation of local revenue to Portsmouth Public Schools; and WHEREAS, City Council desires to rescind the Local Revenue Allocation Policy; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it hereby rescinds the Local Revenue Allocation Policy, and said Policy shall be of no further force or effect; and 2. That this Resolution shall take effect on the date of its adoption.” Ayes: Barnes, Battle, Lucas-Burke, Whitaker, Woodard, Glover Nays: Moody b. Adoption of an ordinance confirming and continuing Ordinance 2020-102 adopted on October 13, 2020 and the emergency procedures established thereunder to ensure the continuity of local government during the COVID-19 pandemic. 1. Mark Geduldig-Yatrofsky, P. O. Box 50141, asked that City Council reevaluate how citizens participate in the meetings. There was a consensus of City Council to direct the Information Technology  department to take the necessary steps that would enable citizens to be on-screen during the Council meetings. Motion by Dr. Whitaker, and seconded by Ms. Lucas-Burke, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE CONFIRMING AND CONTINUING ORDINANCE 2020-102 ADOPTED ON OCTOBER 13, 2020 AND THE EMERGENCY PROCEDURES ESTABLISHED THEREUNDER TO ENSURE THE CONTINUITY OF LOCAL GOVERNMENT DURING THE COVID-19 PANDEMIC.” Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover Nays: None Councilman Whitaker read the following statement:  “Pursuant to Virginia Code subsection 2.2-3712(b), within 15 days of this notice City Council intends to conduct closed meetings at an undisclosed location or electronically for the purpose of interviewing candidates for the position of City Manager. Should the need arise to conduct additional closed meetings for the same purpose after the 15 day period ends, City Council will re-issue this notice.” 21 - 80 - Report on Pending Items Dr. Whitaker asked Interim City Attorney Stromberg on the timeline in which he would  be responding to the following request that was presented at a previous meeting: -VA Code Section 15.2-965.1 -  Changing the code to be applied in a broader manner for the City Manager to use not only in procurement but in any operations of the City. -VA Code Section 12.176 -  Changing the language “purchasing administrator” to City Manager or designee of the City Manager.  If it’s legal for City Council to change the definition of small business.  Interim City Attorney Stromberg informed citizens and City Council that he would provide that information before the next Council meeting.
