<br />3. The Bonds shall provide that (a) neither the Commonwealth of Virginia, the
<br />City nor the Authority shall be obligated to pay the Bonds or the interest thereon or other
<br />costs incident thereto except from the revenues and monies pledged thereto, (b) neither
<br />the faith and credit nor the taxing power of the Commonwealth of Virginia, the City or the
<br />Authority is pledged to the payment of the principal of the Bonds or the interest thereon
<br />or other costs incident thereto, and (c) neither the City, nor any of its elected
<br />representatives, officers, or employees, nor the commissioners, officers or employees of
<br />the Authority, shall be liable personally on the Bonds by reason of their issuance.
<br />
<br />4. In adopting this resolution, the City, including its elected representatives,
<br />officers, employees and agents, shall not be liable for, and hereby disclaims all liability
<br />for, any damages to any person, direct or consequential, resulting from the Authority's
<br />failure to issue the Bonds for any reason.

<br />5. This resolution shall take effect immediately upon its adoption.”

<br />21 - 23 - Adoption of a motion to permit Officers J. Monteith and V. Schultz to adopt
<br />Portsmouth Police Department Canines “Rosco” and “Gunner”, respectively,
<br />German Shepherds.

<br />Background:
<br />
<br /> The K-9 Unit provides security and valuable public relations work to various events
<br />and functions within the city.
<br />
<br /> The Unit provides high visibility patrols throughout the City and assists with the
<br />search and apprehension of violent offenders.
<br />
<br />Discussion:
<br />
<br /> The PPD is retiring two working dogs assigned to the K-9 Unit, German Shepherds
<br />named Rosco and Gunner.
<br />
<br /> Rosco and Gunner are medically unfit due to their ages for continued use by the
<br />K-9 Unit.
<br />
<br /> J. Monteith and V. Schultz, Portsmouth Police Department Officers assigned to
<br />the K-9 Unit and residents of Newport News, VA and Gates, NC, respectively, have
<br />agreed/requested to adopt the canines.
<br />
<br /> The adopters have agreed to abide by the Virginia Anti-Cruelty Laws, Animal
<br />Welfare Laws 1992, and Code of Virginia §3.2-6570
<br />
<br />Financial Impact:
<br />
<br /> There are no costs to the City for these adoptions.
<br />
<br /> The City will relinquish all responsibilities for the feeding, care, upkeep, and
<br />overall well-being of, and any liability related to, these canines.
<br />
<br />Recommended Action:

<br /> Approval of the motion.

<br />Motion by Mr. Barnes, and seconded by Mr. Battle, adopting a motion to permit
<br />Officers J. Monteith and V. Schultz to adopt Portsmouth Police Department Canines
