December 8, 2020 <br /> <br />Motion by Mr. Clark, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE EXECUTION OF A COST SHARING <br />AGREEMENT WITH THE CITY OF NORFOLK FOR THE RELOCATION OF <br />WATERLINES NECESSITATED BY THE COMMONWEALTH RAILWAY <br />MARSHALLING YARD EXPANSION. <br /> <br /> <br /> WHEREAS, <br />as a result of the Commonwealth Railway Marshalling Yard <br />Expansion the City is required to relocate a thirty inch finished waterline from the <br />Commonwealth Railway right of way in Suffolk; and <br /> <br />WHEREAS, <br /> the City of Norfolk is similarly required to relocate a waterline in close <br />proximity to Portsmouth’s line; and <br /> <br />WHEREAS, <br /> by partnering on the relocation Portsmouth and Norfolk have been <br />able to achieve an economy of scale to lower costs and to obtain a Rail Enhancement <br />Fund grant that will cover seventy percent of the eligible costs of the relocation; and <br /> <br />WHEREAS, <br /> the project is ready for bidding, land acquisition and construction, and <br />it is therefore necessary to enter into a formal agreement with Norfolk to cover <br />administration and cost sharing for the project, and to secure the REF grant funding; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that the City Manager is authorized to execute on behalf of the City a Cost Sharing <br />Agreement between the City of Norfolk and the City of Portsmouth for Waterline <br /> <br />Relocation in substantially the form attached hereto as Exhibit A.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- New Business - <br /> <br />20 - 321 - Boards and Commissions <br /> <br />There were no appointments. <br /> <br />20 - 303 - Items Submitted by Council Members <br /> <br />(a) Adoption of an ordinance confirming and continuing Ordinance 2020-102 adopted <br />on October 13, 2020 and the emergency procedures established thereunder to ensure <br />the continuity of local government during the COVID-19 pandemic. <br /> <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, voiced his concern with the diminished <br /> participation by citizens. He also voiced his concern with items being added to the <br /> agenda after the public comment deadline. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE CONFIRMING AND CONTINUING ORDINANCE 2020-102 ADOPTED <br />ON OCTOBER 13, 2020 AND THE EMERGENCY PROCEDURES ESTABLISHED <br />THEREUNDER TO ENSURE THE CONTINUITY OF LOCAL GOVERNMENT DURING <br />THE COVID-19 PANDEMIC.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />(b) Adoption of a resolution authorizing the City Attorney to petition the Portsmouth <br />Circuit Court to hold a special election on November 2, 2021 to fill a vacant seat on City <br />Council. <br /> <br /> <br /> <br /> <br /> <br />
