That ICS Home Investments, LLC is hereby granted a use permit pursuant <br />to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to construct <br />four (4) townhomes at 609 Columbia Street, Tax Parcel 0025-1290, being more <br />particularly described as: <br />UP-19-20 <br /> <br /> <br />609 Columbia Street <br />(Tax Parcel 0025-1290) <br /> <br />ALL THAT certain lot, piece or parcel of land, lying, being and situate in the City of <br />Portsmouth, Virginia and being more particularly bounded and described as follows: <br /> <br />BEGINNING at a point on the south side of Columbia Street 90 feet west of the southwest <br />intersection of Columbia Street and Washington Street and running thence 113 feet south <br />and parallel with Washington Street to a pin, then 90 feet west and parallel with Columbia <br />Street to a pin, thence 113 feet north parallel with Washington Street to Columbia Street, <br />and thence running 90 feet east along Columbia Street to the point of beginning. <br /> <br />IT BEING all that certain property conveyed by RBA-LLC, a Virginia limited liability <br />company, to ICS Home Investments, Inc., a Virginia corporation, by Deed dated October <br />11, 2019 and recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument <br />Number 190010564. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The number of dwelling units on the property shall not exceed four (4). <br /> <br />(b) The design, materials and layout of the development shall be in substantial <br />compliance with the Downtown Design Committee (DDC) Certificate of Appropriateness <br />approvals on August 6, 2019 and February 4, 2020. <br /> <br />(c) The proposed development shall be in substantial compliance with the concept <br />plan entitled Minor Subdivision of 609 Columbia Street, Portsmouth, Virginia, prepared <br />by Pennoni Associates Inc. dated January 28, 2020 and the rendered concept elevations <br />titled Columbia Street Townhouses prepared by GMF+ Associates dated January 27, <br />2020, except where modifications may be required to comply with applicable local, state <br />and federal codes and regulations. <br /> <br />(d) The development shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local government, including but not limited to the Virginia <br />Uniform Statewide Building Code. <br /> <br />(e) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />4.
