May 12, 2020 <br /> <br />Motion by Mr. Clark, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />1. Duff Porter, 226 Constitution Avenue, commented in opposition to the proposed <br />budget. <br /> <br />20-122 (J): <br /> <br />“ORDINANCE TO APPROPRIATE $461,563,317 FOR THE OPERATION OF CITY <br />GOVERNMENT DURING THE FISCAL YEAR BEGINNING JULY 1, 2020.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- New Business - <br /> <br />20 - 123 - Items Submitted by Council Members <br /> <br /> Ms. Psimas informed citizens and City Council that from 6:45 p.m. – 7:00 p.m., May <br /> <br />12, 2020 the Air Force Raptor Squadron will be doing a flyover to honor heroes during <br />this covid-19 pandemic. <br /> <br /> Mr. Glover thanked city leaders, City Council, employees and first responders for <br /> <br />helping citizens to stay safe during this pandemic. He also thanked business owners <br />and assured them that we are all in this together. <br /> <br /> There was a consensus of City Council agreeing with the sentiments of <br />Councilman Glover. <br /> <br />20 - 124 - Motion by Ms. Lucas-Burke, and seconded by Ms. Psimas, to go into a Closed <br />Electronic Meeting pursuant to Virginia Code subsection 2.2-3708 A.3 and City Council <br />Ordinance 2020 - 21 and: <br /> <br /> (A) Virginia Code subsection 2.2-3711 A.3 for the purpose of discussing the <br />disposition of real property where discussion in an open meeting would adversely affect <br />the bargaining position or negotiating strategy of the public body, specifically regarding <br />development of the Victory Village site; and <br /> <br />(B) Virginia Code subsection 2.2-3711 A.7 for the purpose of consultation with <br /> <br />legal counsel pertaining to actual or probable litigation, where such consultation in open <br />meeting would adversely affect the negotiating or litigating posture of the City, specifically <br />regarding Michael A. Moore v. City of Portsmouth, Portsmouth Circuit Court Case <br />Numbers 19003403, 19003277 and 190044811. <br /> <br />The motion was adopted by the following vote: <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, pursuant to Virginia Code <br />Section 2.2-3712(D) certifying that, to the best of the Council Members’ knowledge: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements under the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion by which the <br />Closed Meeting was convened <br /> <br />were heard, discussed, or considered in the closed meeting just concluded by the City <br />Council. <br /> <br /> <br /> <br /> <br /> <br /> <br />
