May 12, 2020 Motion by Mr. Clark, and seconded by Ms. Psimas, to adopt the following ordinance, and was adopted by the following vote: 1. Duff Porter, 226 Constitution Avenue, commented in opposition to the proposed budget. 20-122 (J): “ORDINANCE TO APPROPRIATE $461,563,317 FOR THE OPERATION OF CITY GOVERNMENT DURING THE FISCAL YEAR BEGINNING JULY 1, 2020.” Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe Nays: None - New Business - 20 - 123 - Items Submitted by Council Members Ms. Psimas informed citizens and City Council that from 6:45 p.m. – 7:00 p.m., May  12, 2020 the Air Force Raptor Squadron will be doing a flyover to honor heroes during this covid-19 pandemic. Mr. Glover thanked city leaders, City Council, employees and first responders for  helping citizens to stay safe during this pandemic. He also thanked business owners and assured them that we are all in this together. There was a consensus of City Council agreeing with the sentiments of Councilman Glover. 20 - 124 - Motion by Ms. Lucas-Burke, and seconded by Ms. Psimas, to go into a Closed Electronic Meeting pursuant to Virginia Code subsection 2.2-3708 A.3 and City Council Ordinance 2020 - 21 and: (A) Virginia Code subsection 2.2-3711 A.3 for the purpose of discussing the disposition of real property where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body, specifically regarding development of the Victory Village site; and (B) Virginia Code subsection 2.2-3711 A.7 for the purpose of consultation with legal counsel pertaining to actual or probable litigation, where such consultation in open meeting would adversely affect the negotiating or litigating posture of the City, specifically regarding Michael A. Moore v. City of Portsmouth, Portsmouth Circuit Court Case Numbers 19003403, 19003277 and 190044811. The motion was adopted by the following vote: Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe Nays: None Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, pursuant to Virginia Code Section 2.2-3712(D) certifying that, to the best of the Council Members’ knowledge: 1. Only public business matters lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened were heard, discussed, or considered in the closed meeting just concluded by the City Council.
