<br />At a Called Meeting of the City Council on Monday, March 9, 2020, there were
<br />present:
<br />
<br />Mayor John L. Rowe, Jr., Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr.,
<br />Elizabeth M. Psimas, Nathan J. Clark, Paul J. Battle, City Manager Dr. L. Pettis Patton,
<br />City Attorney Solomon H. Ashby, Jr.
<br />
<br />20 - 88 - The Mayor called the meeting to order and welcomed all in attendance:
<br />

<br /> "Please attend a Called Meeting of the City Council to be held in the 6 Floor
<br />Conference Room, 801 Crawford Street, 6:00 p.m., Monday, March 9, 2020, for the
<br />purpose of a Public Work Session.
<br />
<br /> In addition, you may consider a motion to go into a Closed Meeting.
<br />
<br />By order of the Mayor."
<br />
<br />20 - 89 - The following items were discussed in Public Work Session:
<br />
<br />1. City Jail - Solomon Ashby, City Attorney
<br />
<br />2. Benchmarking Fees and Rates - Gloria Washington, Budget Officer
<br />
<br />3. Meal Tax - Rosylen Oglesby, Assistant City Manager
<br />- There was a consensus of Council to keep this as a matter to discuss during
<br />the budget process.
<br />
<br />4. Capital Improvement Program Highlights - Trey Burke, Budget Officer
<br />- Mayor Rowe asked to get comparison data against other urban cities
<br />regarding the water loss margin. The difference between the amount of water
<br />flowing through the master meter at the plant, and what is being billed. Dr.
<br />Patton will report back.
<br />
<br />20 - 90 - Motion by Ms. Lucas-Burke, and seconded by Ms. Psimas, to go into a Closed
<br />Meeting pursuant to Virginia Code 2.2-3711 A.7 for the purpose of:
<br />
<br />Consultation with legal counsel pertaining to actual or probable litigation, where
<br />such consultation in open meeting would adversely affect the negotiating or litigating
<br />posture of the City, specifically regarding Michael A. Moore v. City of Portsmouth,
<br />Portsmouth Circuit Court Case Numbers 19003403, 19003277 and 19004481.
<br />
<br />The motion was adopted by the following vote:
<br />
<br />Ayes: Battle, Clark, Lucas-Burke, Moody, Psimas, Rowe
<br />Nays: None
<br />
<br />Motion Ms. Lucas-Burke, and seconded by Ms. Psimas, pursuant to Virginia Code
<br />Section 2.2-3712(D) certifying that, to the best of the Council Members’ knowledge:
<br />
<br />1. Only public business matters lawfully exempted from open meeting
<br />requirements under the Virginia Freedom of Information Act, and
<br />
<br />2. Only such public business matters as were identified in the motion by which the
<br />Closed Meeting was convened
<br />
<br />were heard, discussed, or considered in the closed meeting just concluded by the City
<br />Council.

<br /> The motion was adopted by the following vote:
<br />
<br />Ayes: Battle, Clark, Lucas-Burke, Moody, Psimas, Rowe
<br />Nays: None
<br />
<br />On motion, the meeting adjourned at 8:10 p.m.
