<br />December 10, 2019 <br /> <br />At a Called Meeting of the City Council on Tuesday, December 10, 2019 there <br />were present: <br /> <br />Mayor John L. Rowe, Jr., Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., <br />Elizabeth M. Psimas, Nathan J. Clark, *Paul J. Battle, Shannon E. Glover, City Manager <br />Dr. L. Pettis Patton, City Attorney Solomon H. Ashby, Jr. <br /> <br />19 - 449 - The following call for the meeting was read: <br /> <br />th <br /> "Please attend a Called Meeting of the City Council to be held in the 6 Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, December 10, 2019 for the <br />purpose of a Public Work Session. <br /> <br /> In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />19 - 450 - The following items were discussed in Public Work Session: <br /> <br />1. City Council Chamber - Solomon Ashby, City Attorney <br /> <br />-Mayor Rowe asked that staff place this item on the next agenda for Council <br />consideration. <br /> <br />2. Conditional Zoning - Bob Baldwin, Deputy City Manager <br /> <br />3. City Manager’s Report Review/Report Backs - Dr. Patton, City Manager <br /> <br />. <br />4City Council Liaison Reports <br /> <br />-Councilman Clark - <br /> <br /> Tidewater Community College Workforce Solutions Committee meeting and a <br />possible partnership with the City. <br /> <br />19 - 451 - Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, to go into Closed <br />Meeting: <br /> <br />(A) pursuant to Virginia Code subsection 2.2-3711 A.8 for the purpose of consultation <br />with legal counsel employed or retained by the public body regarding specific legal <br />matters requiring the provision of legal advice, specifically regarding Gray Machines; and <br /> <br />(B) pursuant to Virginia Code subsection 2.2-3711 A.7 for the purpose of consultation <br />with legal counsel pertaining to actual or probable litigation, where such consultation in <br />open meeting would adversely affect the negotiating or litigating posture of the City, <br />specifically regarding Michael A. Moore v. City of Portsmouth, Portsmouth Circuit Court <br />Case Numbers 19003403, 19003277 and 19004481, and Integrated Management Group <br />v. City of Portsmouth, Portsmouth Circuit Court Case Number 19002742. <br /> <br /> The motion was adopted by the following vote: <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br /> Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, pursuant to Section 2.2- <br />3712(D) of the Code of Virginia, certifying that to the best of the Council Members’ <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in the <br />meeting by the City Council. <br /> <br /> <br /> <br /> <br /> <br />
