November 12, 2019 <br /> <br /> <br />-Holiday Open House and Craft Market, 4 p.m. - 8 p.m., Friday, November 22, <br />2019 along High Street. <br />th <br /> <br />-35 Annual Grand Illumination Parade, 7 p.m., Saturday, November 23, 2019 in <br />Downtown Norfolk. <br /> <br />-Census part-time employment, 393-8244. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to change the time of <br />the Monday, November 25, 2019 Public Work Session to 5:30 p.m. <br /> <br />19 - 417 - Report on Pending Items <br /> <br /> <br /> Bernadette Hogge, Ombudsman, gave an update on items of concern presented by <br />citizens at the October 22, 2019 City Council Meeting. <br /> <br />19 - 418 - Non-Agenda Speakers <br /> <br />1. Rob Wilber, 208 Park Road, voiced his concern with an inoperable elevator at the <br />Portsmouth Arts and Cultural Center. <br /> <br />2. Dan Evans, 475 Water Street, voiced his concern with the lack of maintenance of <br />city structures and buildings. <br /> <br /> Motion by Ms. Psimas, and seconded by Ms. Lucas-Burke, to go into Closed <br />Meeting: <br /> <br />(B) pursuant to Virginia Code subsection 2.2-3711 A.3 for the purpose of discussing <br />the disposition of real property where discussion in an open meeting would adversely <br />affect the bargaining position or negotiating strategy of the public body, specifically <br />regarding the Victory Crossing area; and <br /> <br />(C) pursuant to Virginia Code subsection 2.2-3711 A.7 for the purpose of consultation <br />with legal counsel pertaining to actual or probable litigation, where such consultation in <br />open meeting would adversely affect the negotiating or litigating posture of the City, <br />specifically regarding Michael A. Moore v. City of Portsmouth, Portsmouth Circuit Court <br />Case Numbers 19003403, 19003277 and 19004481. <br /> <br />(D) pursuant to Virginia Code subsection 2.2-3711 A.7 for the purpose of consultation <br />with legal counsel pertaining to actual or probable litigation, where such consultation in <br />open meeting would adversely affect the negotiating or litigating posture of the City, <br />specifically regarding In Re: National Prescription Opiate Litigation, Case Number 1:17- <br />MD-2804 in the United States District Court for the Northern District of Ohio, Eastern <br />Division and Virginia International Gateway, Inc. v. City of Portsmouth, Virginia, <br />Portsmouth Circuit Court Case Number 15002813; and <br /> <br />(E) pursuant to Virginia Code subsection 2.2-3711 A.3 for the purpose of <br />discussing the acquisition and disposition of real property where discussion in an open <br />meeting would adversely affect the bargaining position or negotiating strategy of the <br />public body, specifically regarding GPDC properties; and <br /> <br />(F) pursuant to Virginia Code subsection 2.2-3711 A.6 for the purpose of <br />discussing or considering of the investment of public funds where competition or <br />bargaining is involved, where, if made public initially, the financial interest of the City <br />would be adversely affected, specifically regarding ownership and maintenance of <br />cemeteries; and <br /> <br />(G) pursuant to Virginia Code subsection 2.2-3711 A.8 for the purpose of consultation <br />with legal counsel employed or retained by a public body regarding specific legal matters <br />requiring the provision of legal advice, specifically regarding City Council meeting <br />procedures. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
