<br /> 86-219 Letter from the City Manager recommending adoption of an ordinance ro amend the
<br />Code of the City of Portsmouth by repealing Sections 8-2 and 8-3 pertaining to the powers and
<br />duties, qualifying bond, fees and compensation of the Office of the high Constable.
<br />
<br /> "In the 1986 Session of the General Assembly, legislation was adopted amending the Charte:
<br />of the City of Portsmouth pertaining to the Office of the High Constable. The effective date
<br />of this legislation is July 1, 1986.
<br />
<br /> The City Attorney advises that it-is also necessary to repeal Sections 8-2 and 8-3 of the
<br />City Code Fertaining to the powers, duties, fees and compensation of the High Constable.
<br />
<br />I recommend that the attached ordinance be adopted."

<br /> On mormon of Mr. Beamer and seconded by Mrs. Webb, the following ordinance was adopted on
<br />first and final reading, and by the following vote:

<br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY

<br /> 86-220 Letter from the City Manager recommending a-doption of an ordinance
<br />Code of the City of Portsmouth by amending Chapter 21 pertaining to miscellaneous
<br />offenses. The following letter covers Items 86-220, 86-221, and 86-222.

<br /> "Th~ office of the City Attorney is ~n the process of coordinating the City's annual revi~
<br />of the actions recently taken by the General Assembly of Virginia. The initial stages of this
<br />review indicates that changes are required in certain provisions ccntained in the City Code
<br />pertaining to: miscellaneous criminal offenses (Chapter 21); motor vehicles and traffic (Chapl
<br />23); Public Procurement Act (Chapter 11).
<br />
<br /> The City Attorney indicates that the majority of the changes are technical in nature but
<br />special reference shoudl be made to amendments pertaining ro driving while intoxicated which
<br />reduces the blood alcohol concentration provisions from 0.15% to 0.10%. The amendments per-
<br />tanning to the Public Procurement Act mandates reasonable notice to the public before the City
<br />uses competitive negotiations in lieu of competitive sealed bidding in the procurement of good~
<br />services, ~nsurance or construction of non-professional services contracts, in addition, the
<br />local schools will be authorized to purchase class rings, year books and graduation materials
<br />by competitive negotiations as opposed to sealed bids.

<br /> The changes included in the following ordinances are mandated by the actions taken bY the
<br />General Assembly, and I concur in the recommendation of the City Attorney that the City Counci[
<br />adopt these ordinances in order to bring the City Code into compliance with the State Code
<br />changes which become effective ~n July 1, 1986."

<br /> On motion of Mr. Corprew and seconded by Mrs. Lucas, the following ordinance was adopted
<br />on first and final reading, and by the following vote:

<br />"AN ORDINANCE ~0 AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973,
<br />BY AMENDING SECTIONS 21-19, 21-21, 21-22, 21-38 (a), 21-38 (d) AND 21-113
<br />PERTAINING TO MISCELLANEOUS CRIMINAL OFFENSES.'

<br />1973, BY AMENDING SECTIONS 23-1 (a), 23-365, 23-375(e), 23-408(b) and (c), 23-520,
<br />23-523 and 23-526 THEREOF AND BY ADOPTING SECTIONS 23-389(e), 23-520.1 and 23-523.1
<br />PERTAINING TO MOTOR VEHICLES AND TRAFFIC."

<br />"AN ORDINANCE TO AMEND SECTION 11-127 OF THE CODE OF THE CITY OF PORTSMOUTH,
<br />VIRGINIA, 1973, PERTAINING TO PROCUREMENT BY COMPETITIVE NEGOTIATION: AND SECTION
<br />11-129 PERTAINING TO EXEMPTIONS FROM THE REQUIRED USE OF SEALED BIDDING OR COM,
<br />PETITIVE NEGOTIATION."
