July 23, 2019 <br /> <br />At a Regular Meeting of the City Council on Tuesday, July 23, 2019, there were <br />present: <br /> <br />Mayor John L. Rowe, Jr., Vice Mayor Lisa L. Lucas-Burke, Elizabeth M. Psimas, Nathan <br />J. Clark, Paul J. Battle, Shannon E. Glover, City Manager Dr. L. Pettis Patton, Assistant <br />City Attorney Burle U. Stromberg. <br /> <br />Vice Mayor Lisa Lucas-Burke opened the meeting with prayer, which was followed <br />by the Pledge of Allegiance to the Flag. <br /> <br /> Mayor Rowe called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, to approve the minutes <br />of a Called Meeting of July 8, 2019, of a Called Meeting of July 9, 2019, and of a Regular <br />Meeting of July 9, 2019, and was adopted by the following vote: <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Psimas, Rowe <br />Nays: None <br /> <br />- Presentations - <br /> <br /> <br /> Special recognition of Department of Social Services Foster Parents. <br /> <br /> <br /> 2019 Neighborhood Incentive Grant Award Recognition. <br /> <br /> <br /> Presentation of proclamation for “National Night Out”. <br /> <br />- Unfinished Business - <br /> <br />Consent Agenda: <br /> <br />19 - 252 - Use permits: <br /> <br />1. Donna Sayegh, 3104 Garland Drive, spoke in opposition to this item. <br /> <br /> Motion by Ms. Psimas, and seconded by Mr. Clark, to adopt the following <br />resolutions approved on first reading at the July 9, 2019 meeting, and was adopted by <br />the following vote: <br /> <br />19-252(a): <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-19-08) TO KABEL & KIM, L.L.C. TO <br />CONSTRUCT AND OPERATE A COFFEE SHOP AND RESTAURANT WITH DRIVE- <br />THROUGH SERVICE AT 5901 WEST HIGH STREET (TAX PARCEL 0816-0030). <br /> <br /> <br />WHEREAS, <br /> Kabel & Kim, L.L.C., the owner of the subject property, by and through <br />its agent R. Troy Parker, has made application pursuant to Section 40.1-2.3B of the Code <br />of the City of Portsmouth, Virginia (2006) for the granting of a use permit to construct and <br />operate a coffee shop and restaurant with drive-through service at 5901 West High Street <br />(Tax Parcel 0816-0030); and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1.
