March 26, 2019 <br /> <br />WHEREAS, <br /> 6S Development LLC, the contract purchaser of the subject property, <br />by and through its agent Robert P. Beaman III, has made application pursuant to Section <br />40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use <br />permit to construct and operate a convenience store with gas sales at property consisting <br />of 700-708 London Street and 720 London Street, Portsmouth, Virginia, and the <br />authorization of certain modifications of zoning standards in conjunction with the use, in <br />accordance with Council’s legislative authority to grant use permits under Virginia law and <br />Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006); and <br /> <br />WHEREAS, <br /> American National Red Cross, Liliben Properties, LLC, Raymond G. <br />Pascual, Elma D. Pascual, Raphael F. Guanzon, Gloria S. Guanzon, and 720 London, <br />Inc., the owners of the property, have consented to the filing of the application; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses <br />permitted in the zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of <br />the proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe <br />road conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring <br />lands to develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That 6S Development LLC is hereby granted a use permit pursuant to <br />Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to construct <br />and operate a convenience store with gas sales at property consisting of 700-708 London <br />Street and 720 London Street, Portsmouth, Virginia, being more particularly described <br />as: <br /> <br />UP-19-02 <br /> <br />700-708 London Street (Tax Parcels 0018-1390 to 0018-1395) <br /> <br />ALL THAT certain lot, piece or parcel of land, situate, lying and being in the City of <br />Portsmouth, Virginia, known, numbered and designated as Disposition Parcel 3, as <br />shown on a certain plat entitled: “Portsmouth Redevelopment and Housing Authority, <br />Urban Renewal – Northside Redevelopment Project No. 1, VA R-39, Boundary and <br />Property line Map, Part I, Portsmouth, Virginia,” dated July 1, 1969, revised March 23, <br />1970, April 30, 1970, January 4, 1971, January 31, 1972 and April 21, 1977, made by R. <br />Kenneth Weeks, Engineers, Norfolk, Virginia, which said plat is duly recorded in the <br /> <br /> <br /> <br /> <br />
