<br />At a Regular Meeting of the City Council on Tuesday, October 9, 2018, there were
<br />present:
<br />
<br />Mayor John L. Rowe, Jr., Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Ray A.
<br />Smith, Sr., Nathan J. Clark, Lisa L. Lucas-Burke, City Manager Dr. L. Pettis Patton, City
<br />Attorney Solomon H. Ashby, Jr.

<br />Pastor Kolbi Shartzer opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Rowe called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Smith, to approve the minutes of a
<br />Called Meeting of September 24, 2018, of a Called Meeting of September 25, 2018, and
<br />of a Regular Meeting of September 25, 2018, and was adopted by the following vote:
<br />
<br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Smith, Rowe
<br />Nays: None

<br />- Public Hearing -
<br />
<br />18-379 Public hearing on the proposed adoption by the City Council of a
<br />resolution to authorize the City to contract a debt and issue general
<br />obligation bonds (the "Bonds") of the City, or notes in anticipation
<br />thereof, in a principal amount estimated not to exceed $10,900,000
<br />to finance the costs of the purchase of fire trucks and various service
<br />vehicles and items of equipment for the City and the costs of issuing
<br />the Bonds.

<br />1. Donna Sayegh, 3104 Garland Drive, spoke in opposition to this item.

<br /> Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the following
<br />ordinance and resolutions approved on first reading at the September 25, 2018 meeting,
<br />and was adopted by the following vote:

<br />“ZONING AMENDMENT ORDINANCE Z-18-04.”

<br />“RESOLUTION GRANTING A USE PERMIT (UP-18-05) TO THE CITY OF
<br />PORTSMOUTH, VIRGINIA TO CONSTRUCT AND OPERATE A 300 FOOT
<br />COMMUNICATIONS TOWER AT 2017 FREDERICK BOULEVARD, TAX PARCEL
<br />0165-0021.
<br />
<br />
<br />WHEREAS,
<br /> the City of Portsmouth, Virginia, the owner of the subject property,
<br />has made application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth,
<br />Virginia (2006) for the granting of a use permit to construct and operate a 300 foot
<br />communications tower at 2017 Frederick Boulevard, Tax Parcel 0165-0021; and
<br />
<br />WHEREAS
<br /> , the applicant and the Planning Director have done all things required
<br />to be done in connection with said application; and
<br />
<br />WHEREAS
<br /> , the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
