October 14, 1986 The following resolution was adopted, ~nd by the following rot "A RESOLUTION APPROVING THE FINAL PLANS AND DESIGNS, AND AWARD OF CONTP~ACT FOR CONSTURCTION OF A PORTION OF THE WESTERN FREEWAY PROJECT FROM CEDAR LANE TO THE WEST NORFOLK BRIDGE: SUBJECT TO CONDITIONS AS SET FORTH. WHEREAS, the Virginia Department of Highways and Transportatior nas requested, as provided by law, that the City Council of Portsmot ~pprove the award of a contract and approve plans.and designs for t~ sonstructlon of a portion of the Western Freeway project from Cedar Lane to the West Norfolk Bridge; and WHEREAS, by resolution of this Council adopted January 22, 198~ the City of Portsmouth instructed th Virginia Department of Highway.~ Transportation that urban highway funds were not to be allocate~ this project and that the Virginia Department of Highways and rcornasn~Pru°~to~°nan~asSu~s°e~°enV~d~a-alnl~natcee ~Usr~.~ ~efstf~rnndi~rgeefw°~y~h~n~I ' WHEREAS, the Virginia Departmen~ of Highways ~n~ Transportatior~l has failed to respond in a positive manner to this request; and WHEREAS, by resolution of this Council adopted May 27, 1986, t~ City of Portsmouth instructed the Virginia~Department of Highways a~ Transportation that any approvals of the City which by law may be ~ecessary in connection with any element of the Western Freeway con- ~ns have b~met: 1. Resolution to the satisfaction of the City Council of the Funding issue. 2. Resolution to the satisfaction issue of the connector between the West Luther King Freeway/Midtown Tunnel. of the City Council of the Norfolk Bridge and Martin 3. Resolution to the satisfaction of the City Council of the issue of priority of the construction phases. WHEREAS, said resolution of May 27, 1986, also instructed the inia Department of Highways and Transportation that further im- plementation towards construction of the Western Freeway Project : ,uld be delayed pending the resolution of the three stated issues WHEREAS, the Virginia Department of Highways and Transportati~ failed to respond in a positive manner to this request and furthermore has continued the administrative process of bidding and awarding contracts for the project; and WHEREAS, the Council of the City'of Portsmouth deems it to be in the best interest of the City to construct that portion of the Western Freeway Project from Cedar Lane to the West Norfolk Bridge only if certain conditions hereinafter set forth are met by the Virginia Department of Highways and Transportation. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the plans, designs and award of contract for construction of that portion of the Western Freeway Project be- tween Cedar Lane and West Norfolk Bridge!be, and the same hereby are: approved; provided, however, said approval is subject to the follow- lng conditions: 1. That the Virginia Department of Highways and Transportatio~ obtain Such approvals as may be necessary to construct all addition~ segments of the Western Freeway Project (Suffolk boundary to Cedar Lane; West Norfolk Bridge to Midtown Tunnel; Martin Luther King Freeway to 1-264) by interstate or primary funding or designation as toll road facilities.
