October 14, 1986 <br /> <br />The following resolution was adopted, ~nd by the following rot <br /> <br />"A RESOLUTION APPROVING THE FINAL PLANS AND DESIGNS, AND <br />AWARD OF CONTP~ACT FOR CONSTURCTION OF A PORTION OF THE <br />WESTERN FREEWAY PROJECT FROM CEDAR LANE TO THE WEST NORFOLK <br />BRIDGE: SUBJECT TO CONDITIONS AS SET FORTH. <br /> <br /> WHEREAS, the Virginia Department of Highways and Transportatior <br />nas requested, as provided by law, that the City Council of Portsmot <br />~pprove the award of a contract and approve plans.and designs for t~ <br />sonstructlon of a portion of the Western Freeway project from Cedar <br />Lane to the West Norfolk Bridge; and <br /> <br /> WHEREAS, by resolution of this Council adopted January 22, 198~ <br />the City of Portsmouth instructed th Virginia Department of Highway.~ <br /> Transportation that urban highway funds were not to be allocate~ <br /> this project and that the Virginia Department of Highways and <br />rcornasn~Pru°~to~°nan~asSu~s°e~°enV~d~a-alnl~natcee ~Usr~.~ ~efstf~rnndi~rgeefw°~y~h~n~I <br /> ' WHEREAS, the Virginia Departmen~ of Highways ~n~ Transportatior~l <br />has failed to respond in a positive manner to this request; and <br /> <br /> WHEREAS, by resolution of this Council adopted May 27, 1986, t~ <br />City of Portsmouth instructed the Virginia~Department of Highways a~ <br />Transportation that any approvals of the City which by law may be <br />~ecessary in connection with any element of the Western Freeway con- <br /> ~ns have b~met: <br /> <br />1. Resolution to the satisfaction of the City Council of the <br />Funding issue. <br /> <br /> 2. Resolution to the satisfaction <br />issue of the connector between the West <br />Luther King Freeway/Midtown Tunnel. <br /> <br />of the City Council of the <br />Norfolk Bridge and Martin <br /> <br /> 3. Resolution to the satisfaction of the City Council of the <br />issue of priority of the construction phases. <br /> <br /> WHEREAS, said resolution of May 27, 1986, also instructed the <br /> inia Department of Highways and Transportation that further im- <br />plementation towards construction of the Western Freeway Project : <br /> ,uld be delayed pending the resolution of the three stated issues <br /> <br /> WHEREAS, the Virginia Department of Highways and Transportati~ <br />failed to respond in a positive manner to this request and <br />furthermore has continued the administrative process of bidding and <br />awarding contracts for the project; and <br /> <br /> WHEREAS, the Council of the City'of Portsmouth deems it to be <br />in the best interest of the City to construct that portion of the <br />Western Freeway Project from Cedar Lane to the West Norfolk Bridge <br />only if certain conditions hereinafter set forth are met by the <br />Virginia Department of Highways and Transportation. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the plans, designs and award of contract <br />for construction of that portion of the Western Freeway Project be- <br />tween Cedar Lane and West Norfolk Bridge!be, and the same hereby are: <br />approved; provided, however, said approval is subject to the follow- <br />lng conditions: <br /> <br /> 1. That the Virginia Department of Highways and Transportatio~ <br />obtain Such approvals as may be necessary to construct all addition~ <br />segments of the Western Freeway Project (Suffolk boundary to Cedar <br />Lane; West Norfolk Bridge to Midtown Tunnel; Martin Luther King <br />Freeway to 1-264) by interstate or primary funding or designation <br />as toll road facilities.
