<br />July 11, 2017 <br /> <br />At a Called Meeting of the City Council on Tuesday, July 11, 2017, there were <br />present: <br /> <br />Mayor John L. Rowe, Jr., Vice Mayor Paige D. Cherry, William E. Moody, Jr., Elizabeth <br />M. Psimas, *Dr. Mark M. Whitaker, Nathan J. Clark, Lisa L. Lucas-Burke, City Manager <br />Dr. L. Pettis Patton, City Attorney Solomon H. Ashby, Jr. <br /> <br />17 - 286 - The following call for the meeting was read: <br /> <br />th <br /> "Please attend a Called Meeting of the City Council to be held in the 6 Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, July 11, 2017 for the <br />purpose of a Public Work Session. <br /> <br /> In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />17 - 287 - The following items were discussed in Public Work Session: <br /> <br />1. Franchise Agreement Considerations - Solomon Ashby, City Attorney <br /> <br /> <br />-The following questions were asked of City Council: <br />1. Does City Council wish to have the City advocate for both public safety <br />infrastructure and bandwidth needs as we go forward in negotiating franchise <br />agreements? <br /> <br /> There was a consensus of agreement by City Council. <br /> <br />2. Does City Council wish to have the City advocate for the protection of the <br />public safety infrastructure and the bandwidth needs of our partners as we go <br />forward in negotiating franchise agreements? <br /> <br /> There was a consensus of agreement by City Council. <br /> <br />3. Does City Council wish to have the City advocate for the placement of all new <br />facilities to remain underground as we go forward in negotiating franchise <br />agreements? <br /> <br /> There was a consensus of agreement by City Council. <br /> <br />4. Does City Council wish to have the City advocate for the placement of <br />infrastructure that would be required to be above ground on the right of way, on <br />the private property adjacent to the right of way or on public land? <br /> <br /> City Council’s preference was for co-location. Where it cannot be co-located <br />and has to be on private property City Council reserves the right to regulate <br />through the Planning Department. <br /> <br />5. Does City Council wish to have the City advocate to have telecommunication <br />companies at least engage the partners either for an alternative location, on land <br />they may be associated with, or at least have a discussion with them if they are <br />considering locating in areas associated with property owners? <br /> <br /> Vice Mayor wanted to make sure City Council’s preferences were known in <br />cases of absentee landlords that may not have a preference with regards to <br />the design or location of telecommunication devices. <br /> <br /> Councilman Whitaker asked what the expected tax revenue was for the State as <br /> <br />opposed to the City and if there would be any revenue opportunities for the City. <br /> <br /> Dr. Patton, City Manager, informed City Council that staff would come back with <br />that information. <br /> <br /> Councilman Moody asked if machine and tool tax were precluded by the Federal <br /> <br />Communications Commission (FCC) or the State. <br /> <br /> Dr. Patton, City Manager, informed City Council that staff would come back with <br />that information. <br /> <br /> <br /> <br /> <br />
