<br />At a Called Meeting of the City Council on Monday, February 27, 2017, there were

<br />M. Psimas, Dr. Mark M. Whitaker, Nathan J. Clark, Lisa L. Lucas-Burke, City Manager

<br />17 - 97 - The following call for the meeting was read:
<br />
<br /> "Please attend a Called Meeting of the City Council to be held in the City Council
<br />Chamber, 801 Crawford Street, 6:00 p.m., Monday, February 27, 2017 for the purpose of
<br />a Public Work Session.
<br />
<br /> In addition, you may consider a motion to go into a Closed Meeting.
<br />
<br />By order of the Mayor."
<br />

<br />17 - 98 - The following items were discussed in Public Work Session:
<br />
<br />1. Joint City Council & School Board Discussions - Dr. Elie Bracy, III, Superintendent
<br />and Brittany Dortch, Director of Finance for Schools
<br />
<br />17 - 99 - Motion by Ms. Lucas-Burke, and seconded by Ms. Psimas, to go into a Closed
<br />Meeting pursuant to Virginia Code 2.2-3711 A.1 for the purpose of:
<br />
<br />Consultation with legal counsel pertaining to actual or probable litigation, where
<br />such consultation in open meeting would adversely affect the negotiating or litigating
<br />posture of the City, specifically regarding Toni Dixon, Administratrix for the Estate of
<br />Marshal Franklin v. Edward G. Hargis, Portsmouth Circuit Court case number CL
<br />1000225-00.
<br />
<br />The motion was adopted by the following vote:
<br />
<br />Ayes: Clark, Cherry, Lucas-Burke, Moody, Psimas, Whitaker, Rowe
<br />Nays: None
<br />
<br />Motion by Ms. Psimas, and seconded by Mr. Moody, pursuant to Virginia Code
<br />Section 2.2-3712(D) certifying that, to the best of the Council Members’ knowledge:
<br />
<br />1. Only public business matters lawfully exempted from open meeting
<br />requirements under the Virginia Freedom of Information Act, and
<br />
<br />2. Only such public business matters as were identified in the motion by which the
<br />Closed Meeting was convened
<br />
<br />were heard, discussed or considered in the closed meeting just concluded by the City
<br />Council.
