<br />September 27, 2016 <br /> <br />At a Called Meeting of the City Council on Tuesday, September 27, 2016, there <br />were present: <br /> <br />Mayor Kenneth I. Wright, *Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige <br />D. Cherry, Dr. Curtis E. Edmonds, Sr., Dr. Mark M. Whitaker, City Manager Dr. L. Pettis <br />Patton, City Attorney Solomon H. Ashby, Jr. <br /> <br />16 - 300 - The following call for the meeting was read: <br /> <br />th <br /> "Please attend a Called Meeting of the City Council to be held in the 6 Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, September 27, 2016 for the <br />purpose of a Public Work Session. <br /> <br /> In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />16 - 301 - The following items were discussed in Public Work Session: <br /> <br />1. Hampton Roads Crossing Study - Virginia Department of Transportation (VDOT) <br />presentation - Scott Smizik, Project Manager, VDOT <br /> <br />2. Women and Minority Business Enterprise (WMBE) Policy Discussion - Solomon <br />Ashby, City Attorney <br /> <br />3. Civil Service Commission Update - Mayor Wright <br /> <br />4. City Council Liaison Reports - <br /> <br />-Councilman Whitaker - <br /> <br /> Portsmouth Redevelopment and Housing Authority update. <br /> <br />16 - 302 - Motion by Mr. Moody, and seconded by Dr. Edmonds, to go into a Closed <br />Meeting pursuant subsection 2.2-3711 A.7 for the purpose of consultation with legal <br />counsel pertaining to actual or probable litigation, where such consultation in open <br />meeting would adversely affect the negotiating or litigating posture of the City, specifically <br />regarding Virginia International Gateway, Inc. v. City of Portsmouth, Virginia, Portsmouth <br />Circuit Court case number CL 16001427-00; and <br /> <br /> pursuant to Virginia Code subsections 2.2-3711 A.6 and A.29 for the purpose of <br />discussing the award of a public contract involving the expenditure of public funds and <br />the investment of public funds where competition or bargaining is involved, where <br />discussion in an open session would adversely affect the bargaining position or <br />negotiating strategy of the City and the financial interest of the City, specifically regarding <br />existing and potential future contractual relationships with the Southeastern Public <br />Service Authority for post-2018 waste disposal services and the construction of a transfer <br />station; and <br /> <br /> pursuant to Virginia Code subsection 2.2-3711 A.7 for the purpose of consultation <br />with legal counsel pertaining to actual or probable litigation, where such consultation in <br />open meeting would adversely affect the negotiating or litigating posture of the City, <br />specifically regarding David R. Tynch v. Greater Portsmouth Development Corporation, <br />filed in Portsmouth Circuit Court as Case Number CL16002723-00; and <br /> <br />pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of discussing <br />and considering the performance of appointees, specifically regarding Council <br />appointees. <br /> <br />The motion was adopted by the following vote: <br /> <br />Ayes: Cherry, Edmonds, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br /> <br /> <br /> <br /> <br />
