August 23, 2016 <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Occupancy of the child day care center shall be limited to no more than fifty (50) <br />children. <br /> <br />(b) The days and hours of operation for the child day care activities shall be limited <br />to Monday through Friday commencing no earlier than 5:00 a.m. and ending no later <br />than 8:30 p.m. <br /> <br />(c) Outdoor play at the child day care center shall be limited to Monday through <br />Friday no earlier than 8:00 a.m. to no later than 6:00 p.m. The proposed outdoor play <br />area shall comply with Portsmouth City Code Section 40.1-4.3(B)(1)(iii). <br /> <br />(d) The applicant shall maintain at least eleven (11) parking spaces within the church <br />parking for the drop-off/pick-up of children and staff parking. The spaces shall be <br />configured so that children do not have to cross vehicular travelways to enter or exit the <br />child day care center facility. <br /> <br />(e) The facility shall be operated in compliance with all applicable codes, ordinances <br />and regulations of federal, state and local government and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the child day care <br />center. <br /> <br />(f) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Cherry, Edmonds, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />16 - 265 - Adoption of an ordinance amending subsection 9-26(a) of Chapter 9 of <br />the Code of the City of Portsmouth, Virginia (2006) to define the term “Mount <br />Calvary Cemetery Complex”. <br />Vision Principle: Innovation and Change. <br /> <br />Background: <br /> <br /> The current Section 9-26(b) references the “Mount Calvary Cemetery Complex” <br />as city cemeteries but does not define what that term means. The suggested <br />amendment to the City Code would accordingly define the term “Mount Calvary <br />Cemetery Complex” in Section 9-26(a). <br /> <br />Financial Impact: <br /> <br /> <br /> None. <br /> <br />Recommended Action: <br /> <br /> Adoption of language amending Section 9-26(a) of the City Code to define <br />“Mount Calvary Cemetery Complex” to include Mt. Olive Cemetery, Fisher’s Hill <br />Cemetery, Pauper’s Field Cemetery and Mt. Calvary Cemetery. Vision Principle: <br />Innovation and Change by facilitating future development of City facilities. <br /> <br />Next Steps following City Council Action: <br /> <br /> The City Code will be updated to include the amendment to Section 9-26(a). <br /> <br />Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE AMENDING SUBSECTION 9-26(A) OF CHAPTER 9 OF THE CODE <br />OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) TO DEFINE THE TERM “MOUNT <br />CALVARY CEMETERY COMPLEX”.” <br /> <br /> <br /> <br />
