August 23, 2016 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Occupancy of the child day care center shall be limited to no more than fifty (50) children. (b) The days and hours of operation for the child day care activities shall be limited to Monday through Friday commencing no earlier than 5:00 a.m. and ending no later than 8:30 p.m. (c) Outdoor play at the child day care center shall be limited to Monday through Friday no earlier than 8:00 a.m. to no later than 6:00 p.m. The proposed outdoor play area shall comply with Portsmouth City Code Section 40.1-4.3(B)(1)(iii). (d) The applicant shall maintain at least eleven (11) parking spaces within the church parking for the drop-off/pick-up of children and staff parking. The spaces shall be configured so that children do not have to cross vehicular travelways to enter or exit the child day care center facility. (e) The facility shall be operated in compliance with all applicable codes, ordinances and regulations of federal, state and local government and all required licenses and permits shall be obtained and remain in effect during the operation of the child day care center. (f) All taxes/fees associated with the property and/or the proposed use shall be paid when due. REVOCATION OF PERMIT: 4. Violation of any of the above conditions may serve as grounds for revocation of the use permit by City Council.” Ayes: Cherry, Edmonds, Moody, Psimas, Whitaker, Wright Nays: None - City Manager’s Report - 16 - 265 - Adoption of an ordinance amending subsection 9-26(a) of Chapter 9 of the Code of the City of Portsmouth, Virginia (2006) to define the term “Mount Calvary Cemetery Complex”. Vision Principle: Innovation and Change. Background:  The current Section 9-26(b) references the “Mount Calvary Cemetery Complex” as city cemeteries but does not define what that term means. The suggested amendment to the City Code would accordingly define the term “Mount Calvary Cemetery Complex” in Section 9-26(a). Financial Impact:  None. Recommended Action:  Adoption of language amending Section 9-26(a) of the City Code to define “Mount Calvary Cemetery Complex” to include Mt. Olive Cemetery, Fisher’s Hill Cemetery, Pauper’s Field Cemetery and Mt. Calvary Cemetery. Vision Principle: Innovation and Change by facilitating future development of City facilities. Next Steps following City Council Action:  The City Code will be updated to include the amendment to Section 9-26(a). Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE AMENDING SUBSECTION 9-26(A) OF CHAPTER 9 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) TO DEFINE THE TERM “MOUNT CALVARY CEMETERY COMPLEX”.”
