<br />At a Regular Meeting of the City Council on Tuesday, August 23, 2016, there
<br />were present:
<br />
<br />Mayor Kenneth I. Wright, Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige
<br />D. Cherry, Dr. Curtis E. Edmonds, Sr., Dr. Mark M. Whitaker, City Manager Dr. L. Pettis
<br />Patton, City Attorney Solomon H. Ashby, Jr.
<br />
<br />Pastor Marc Neppl opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Wright called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Dr. Edmonds, and seconded by Ms. Psimas, to approve the minutes of
<br />a Called Meeting of August 9, 2016, and of a Regular Meeting of August 9, 2016, and
<br />was adopted by the following vote:
<br />
<br />Ayes: Cherry, Edmonds, Moody, Psimas, Whitaker, Wright
<br />Nays: None

<br /> Public Hearing
<br />
<br />16-264 Public hearing on the proposed adoption of a resolution to authorize the
<br />City to contract a debt and issue general obligation qualified zone
<br />academy bonds (the "Bonds") of the City, or notes in anticipation thereof,
<br />in a principal amount not to exceed $6,143,000 to finance the costs of the
<br />rehabilitation and repair of certain public schools in the City and the costs
<br />of issuing the Bonds.

<br />1. Maggie Magruder, 111 High Street, spoke in opposition to this item.
<br />
<br />2. Donna Sayegh, 3104 Garland Drive, spoke in opposition to this item.

<br />- Unfinished Business -
<br />
<br />16 - 249 - use permit:
<br />
<br />(a) UP-16-05 EBONY HEIGHTS - Raquel Owens requests a use permit for a
<br />Family Child Day Care Home at 3511 Pierce Street to care for up to
<br />twelve children under the age of 13 years old. The Comprehensive
<br />Plan’s Generalized Future Land Use Map recommends low to
<br />medium density residential development. Deferred from the August
<br />9, 2016 City Council meeting. Vision Principles: A Robust and
<br />Prospering Economy and Enhanced Quality of Life.
<br />
<br />1. Raquel Owens, 3511 Pierce Street, spoke in support of this item.
<br />
<br />Motion by Dr. Whitaker, and seconded by Mr. Moody, to concur with the
<br />recommendation of the Planning Commission that UP-16-05 be approved on first
<br />reading, and was adopted by the following vote:
<br />
<br />Ayes: Cherry, Edmonds, Moody, Psimas, Whitaker, Wright
<br />Nays: None
<br />
<br /> Motion by Dr. Whitaker, and seconded by Ms. Psimas, to adopt the following
<br />resolution approved on first reading at the August 9, 2016 meeting, and was adopted by
<br />the following vote:

<br />“RESOLUTION GRANTING A USE PERMIT (UP-16-07) TO NEW BEREAN BAPTIST
<br />CHURCH TO OPERATE A CHILD DAY CARE CENTER AT 3600 BAMBOO ROAD.
