<br />At a Regular Meeting of the City Council on Tuesday, January 26, 2016, there
<br />were present:
<br />
<br />Mayor Kenneth I. Wright, Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige
<br />D. Cherry, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, Dr. Mark M. Whitaker, City
<br />Manager Dr. L. Pettis Patton, City Attorney Solomon H. Ashby, Jr.
<br />
<br />Reverend Dr. Johnnie Drake opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Wright called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Dr. Edmonds, and seconded by Mr. Meeks, to approve the minutes of
<br />a Called Meeting of January 12, 2016, of a Regular Meeting of January 12, 2016, and of
<br />a Called Meeting of January 19, 2016, and was adopted by the following vote:
<br />
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright
<br />Nays: None
<br />
<br />
<br /> Recognition of the Woodrow Wilson High School Marching Presidents for their
<br />participation in the TaxSlayer Bowl (Gator Bowl).

<br />Consent Agenda:

<br />16 - 08 - Rezoning and use permits:
<br />
<br /> Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following
<br />resolution and ordinances approved on first reading at the January 12, 2016 meeting,
<br />and was adopted by the following vote:
<br />
<br />16-08 (b):
<br />
<br />“RESOLUTION GRANTING A USE PERMIT (UP-15-13) FOR THE OPERATION OF A
<br />RESTAURANT AT 1 BIDE-A-WEE LANE.
<br />
<br />
<br />WHEREAS,
<br /> World Class Enterprises, LLC, by and through its agents
<br />Christopher Brown and Ovelton Malone, has made application pursuant to Section 40.1-
<br />2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use
<br />permit for the operation of a restaurant at 1 Bide-A-Wee Lane; and
<br />
<br />WHEREAS,
<br /> the City of Portsmouth, the owner of the property, has consented to
<br />the filing of the application; and
<br />
<br />WHEREAS
<br /> , the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />
<br />WHEREAS
<br /> , the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED
<br /> by the Council of the City of
<br />Portsmouth, Virginia:
<br />
<br /> 1. That it finds that the use for which the permit is sought:
<br />
<br />(a) Complies with the applicable standards of the Zoning Ordinance;
<br />
<br />(b) Is consistent with the comprehensive plan;
<br />
<br />(c) Is compatible with the character of surrounding lands and the uses permitted in
<br />the zoning district(s) of surrounding lands;
