September 22, 2015 <br /> <br />At a Regular Meeting of the City Council on Tuesday, September 22, 2015, there <br />were present: <br /> <br />Mayor Kenneth I. Wright, Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige <br />D. Cherry, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, Dr. Mark M. Whitaker, City <br />Manager Dr. L. Pettis Patton, Assistant City Attorney Jeff S. Miller. <br /> <br />Pastor Billy Collins opened the meeting with prayer, which was followed by the <br />Pledge of Allegiance to the Flag. <br /> <br /> Mayor Wright called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Meeks, to approve the minutes of a <br />Called Meeting of September 8, 2015, of a Regular Meeting of September 8, 2015, a <br />Called Meeting of September 14, 2015 and of a Called meeting of September 15, 2015, <br />and was adopted by the following vote: <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />15 - 322 - Use permit: <br /> <br /> Motion by Mr. Meeks, and seconded by Ms. Psimas, to adopt the following <br />resolution approved on first reading at the September 8, 2015 meeting, and was <br />adopted by the following vote: <br /> <br />15-322: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-15-09) FOR THE EXPANSION OF <br />AN EXISTING FUEL OPERATIONS FACILITY AT 700 MOUNT VERNON AVENUE. <br /> <br /> <br />WHEREAS, <br /> SEJ Asset Management & Investment Company, the owner of the <br />subject property, by and through its agent Stephen R. Romine, Esquire, has made <br />application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia <br />(2006) for the granting of a use permit for the expansion of an existing fuel operations <br />facility at 700 Mount Vernon Avenue; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br /> <br /> <br /> <br />
