August 25, 2015 <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The proposed development shall be in substantial compliance with the plan <br />entitled “Preliminary Site Plan for Tri-State Grand Council Lodge” dated May 12, 2015, <br />Portsmouth, Virginia, prepared by CAE, INC., Engineers, Planners and Construction <br />Consultants, Virginia Beach, Virginia. <br /> <br />(b) The development plan shall be submitted for Site Plan Review, administered <br />through the Engineering Department, and shall address the required parking area as <br />well as the required landscaping buffers. <br /> <br />(c) The facility’s operation shall be limited to Monday through Sunday no earlier than <br />8:00 a.m. to no later than 10:00 p.m. <br /> <br />(d) The occupant load for the building shall be limited to 119 persons. The occupant <br />load for the upstairs shall be limited to 50 persons due to only one stairway exit. <br /> <br />(e) There shall not be any frying of foods or other food preparation that creates <br />grease laden vapors, smoke, or moisture laden byproducts from the cooking operation. <br />Any change in the function of food preparation from a warming kitchen will require <br />commercial cooking appliances, commercial range hoods, and fire suppression <br />systems. Should the kitchen facilities be improved as approved by the Building Official, <br />this condition will no longer apply, subject to any limitations imposed by the Building <br />Official. <br /> <br />(f) The proposed development shall be required to provide a 10-foot wide buffer of <br />landscaping between the residential development to the east, west and south and the <br />City right-of-way to the north. <br /> <br />(g) The facility shall be operated in compliance with applicable codes, ordinances <br />and regulations of federal, state and local government, and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the facility. <br /> <br />(h) All taxes/fees associate with the property and/or the use shall be paid when due. <br /> <br />(i) The owner/operator shall comply with Portsmouth City Code Sec. 24-255 – <br />Unlawful excessive sound (the Noise Ordinance) during site operations. <br /> <br />(j) Site activities shall preclude car washes and similar outdoor events. Site <br />activities shall be solely internal to the structure on the Property. <br /> <br />(k) If the Chief of Police, in his discretion, determines that there is a significant risk to <br />public safety or peace and good order then proceedings to revoke the use permit may <br />be initiated by the Director of Planning and the use permit may be revoked. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />1.
