<br />At a Regular Meeting of the City Council on Tuesday, June 23, 2015, there were
<br />present:
<br />
<br />Mayor Kenneth I. Wright, Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige
<br />D. Cherry, Dr. Curtis E. Edmonds, Sr., *Danny W. Meeks, Dr. Mark M. Whitaker, Interim
<br />City Manager J. Brannon Godfrey, Jr., Interim City Attorney Cheran D. Cordell.
<br />
<br />Reverend Peter Grana opened the meeting with prayer, which was followed by
<br />the Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Wright called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Dr. Edmonds, and seconded by Mr. Moody, to approve the minutes of
<br />a Called Meeting of June 8, 2015, of a Called Meeting of June 9, 2015, and of a Regular
<br />Meeting of June 9, 2015, and was adopted by the following vote:
<br />
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright
<br />Nays: None
<br />
<br />- Public Hearing -
<br />
<br />15-244 DOWNTOWN - Adoption of a resolution revoking the use permit
<br />(UP-08-17) to Charles Greenhood for an Entertainment
<br />Establishment at 467 Court Street, Portsmouth, Virginia, in
<br />accordance with Section 40.1-2.3(B)(8) of the City of Portsmouth
<br />Zoning Ordinance. The reason for considering revoking of the use
<br />permit is due to the failure of the establishment to comply with one
<br />or more conditions of approval. The entertainment establishment
<br />at 467 Court Street is known as and/or associated with Brutti’s
<br />Restaurant, also known as the Mansion, Moroccan Ballroom,
<br />Metropolis Ballroom, and the Penthouse. The property is owned by
<br />CHASKAT, L.L.C. Vision Principle: Quality of Life.

<br />1. Robert Simmons, Jr., 1103 South Military Highway, Chesapeake, confirmed that
<br /> once a use permit is revoked the ABC license is not valid.
<br />
<br />2. Irv Lindley, 218 Glasgow Street, spoke in support of this item.
<br />
<br />3. Valerie Cosnotti, 430 Court Street, spoke in support of this item.
<br />
<br />4. Larry Preddy, 361 Court Street, spoke in support of this item.
<br />
<br />5. Dr. Wilbur Kersey, 447 Court Street, spoke in support of this item.
<br />
<br />6. Terry Danaher, 413 Dinwiddie Street, spoke in support of this item.
<br />
<br />7. Charles Greenhood, 467 Court Street, voiced his concern with comments made by
<br /> previous speakers and thanked those that had supported his business.
<br />
<br />8. Tony Goodwin, 38 Linden Avenue, asked that the stigma of this business not hinder
<br /> others from occupying the space.
<br />
<br />9. Mark Geduldig-Yatrofsky, P. O. Box 50141, spoke in support of this item.
<br />
<br />Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following
<br />resolution, and was adopted by the following vote:
<br />
<br />“RESOLUTION REVOKING USE PERMIT UP-08-17 FOR THE OPERATION OF AN
<br />ENTERTAINMENT ESTABLISHMENT AT 467 COURT STREET.
<br />
<br />
<br />WHEREAS,
<br /> by Resolution R-08-48 adopted on October 28, 2008 the Council of
<br />the City of Portsmouth, Virginia granted a conditional Use Permit to Charles Greenhood
<br />to operate an entertainment establishment at 467 Court Street (the “Use Permit”); and
<br />
