<br />At a Regular Meeting of the City Council on Tuesday, May 12, 2015, there were
<br />present:

<br />Mayor Kenneth I. Wright, Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige
<br />D. Cherry, Dr. Curtis E. Edmonds, Sr., *Danny W. Meeks, Dr. Mark M. Whitaker, Interim
<br />City Manager J. Brannon Godfrey, Jr., Interim City Attorney Cheran D. Cordell.
<br />
<br />Reverend Joe Cailles opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Wright called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Meeks, to approve the minutes of a
<br />Called Meeting of April 27, 2015, of a Called Meeting of April 28, 2015, of a Regular
<br />Meeting of April 28, 2015, and of a Called Meeting of May 5, 2015 with the correction of
<br />the adjournment time from 10:30 a.m. to 10:30 p.m. for the April 28 Regular meeting
<br />minutes and was adopted by the following vote:

<br />Nays: None

<br />- Public Hearing -
<br />
<br />15 - 196 - Public hearing on a code amendment, use permit and street name change
<br />applications:
<br />
<br />(a) CA-15-01 CITY-WIDE - Proposed amendments to Chapter 14 of the Code of
<br />City of Portsmouth pertaining to Flood Protection. The proposed
<br />amendments modify references to the latest Flood Insurance Rate
<br />Maps (FIRMs) to become effective in June, 2015. These maps
<br />include an increase in the Base Flood Elevation (BFE) based on an
<br />in-depth series of studies by the Federal Emergency Management
<br />Agency (FEMA). The amendments will also mention sea level rise
<br />for the first time. Other changes include: adding a Coastal A Zone
<br />and Limits of Moderate Wave Action (LiMWA), proposes a
<br />freeboard of 3 feet above the BFE, designates a Floodplain
<br />Administrator, and modifies other provisions recommended or
<br />required to maintain eligibility under the National Flood Insurance
<br />Program. Vision Principle: A Robust Economy for Working Men
<br />and Women.

<br />1. Joshua Clark, 2117 Smith Avenue, Chesapeake, spoke in opposition to this item.
<br />
<br />Motion by Ms. Psimas, and seconded by Mr. Moody, to defer this item to come
<br />back as a public hearing on May 26, 2015, and was adopted by the following vote:

<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright
<br />Nays: None
<br />
<br />(b) UP-15-04 MIDTOWN - Donald L. Curry, Jr., PE, representing Curry
<br />Engineering, requests a use permit for a Taco Bell restaurant with
<br />a drive-through at 1501 Frederick Boulevard. The property is
<br />designated for commercial development and is denoted as a
<br />Regional Activity Center on the City’s Comprehensive Plan’s
<br />Generalized Future Land Use Map. Vision Principle: A Robust
<br />Economy for Working Men and Women.

<br />Motion by Mr. Meeks, and seconded by Ms. Psimas, to concur with the
<br />recommendation of the Planning Commission that UP-15-04 be approved on first
<br />reading, and was adopted by the following vote:
