January 5, 2015 At a Called Meeting of the City Council on Monday, January 5, 2015, there were present: Mayor Kenneth I. Wright, William E. Moody, Jr., Elizabeth M. Psimas, Paige D. Cherry, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, Dr. Mark M. Whitaker, City Manager John L. Rowe, Jr., City Attorney George M. Willson.. 15 - 04 -The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6t" Floor Conference Room, 801 Crawford Street, 12:00 p.m. Monday, January 5, 2015, for the purpose of a Reorganization Meeting. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 15 - 05 -The following item was discussed in Public Work Session: 1. Discussion of motion to establish rescheduled meeting dates -George M. Willson, City Attorney 15 - 06 -Motion by Mr. Moody, and seconded by Mr. Meeks, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 of the Code of Virginia for the purpose of the following: Discussion of the appointment of a Vice Mayor and of other Council appointments, as permitted under Subsection A.1; and Consultation with legal counsel pertaining to actual litigation (Funkhouser, et al. v. City), as permitted under Subsection A.1. Dr. Whitaker raised a point of order that the motion to go into closed session to discuss the appointment of a Vice Mayor and of other Council appointments did not fall under topics to be discussed under Subsection A.1 of the Freedom of Information Act. Mayor Wright ruled that the discussion to appoint a Vice Mayor would be discussed in open session and the discussion of appointments to Council would be discussed in closed session. Dr. Whitaker raised a point of order that the motion to go into closed session to discuss Council appointments did not fall under Subsection A.1. Mayor Wright ruled that the discussion to appoint a Vice Mayor and the discussion of appointments to Council would be discussed in open session. Motion by Ms. Psimas, and seconded by Mr. Meeks, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 of the Code of Virginia for the purpose of the following: Consultation with legal counsel pertaining to actual litigation (Funkhouser, et al. v. City), as permitted under Subsection A.1. The motion was adopted by the following vote: Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright Nays: None Motion by Ms. Psimas, and seconded by Mr. Meeks, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Member's knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and
