January 5, 2015 <br />At a Called Meeting of the City Council on Monday, January 5, 2015, there were <br />present: <br />Mayor Kenneth I. Wright, William E. Moody, Jr., Elizabeth M. Psimas, Paige D. Cherry, <br />Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, Dr. Mark M. Whitaker, City Manager John <br />L. Rowe, Jr., City Attorney George M. Willson.. <br />15 - 04 -The following call for the meeting was read: <br />"Please attend a Called Meeting of the City Council to be held in the 6t" Floor <br />Conference Room, 801 Crawford Street, 12:00 p.m. Monday, January 5, 2015, for the <br />purpose of a Reorganization Meeting. <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />15 - 05 -The following item was discussed in Public Work Session: <br />1. Discussion of motion to establish rescheduled meeting dates -George <br />M. Willson, City Attorney <br />15 - 06 -Motion by Mr. Moody, and seconded by Mr. Meeks, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711 of the Code of Virginia for the purpose of the <br />following: <br />Discussion of the appointment of a Vice Mayor and of other Council <br />appointments, as permitted under Subsection A.1; and <br />Consultation with legal counsel pertaining to actual litigation (Funkhouser, et al. <br />v. City), as permitted under Subsection A.1. <br />Dr. Whitaker raised a point of order that the motion to go into closed session to <br />discuss the appointment of a Vice Mayor and of other Council appointments did not fall <br />under topics to be discussed under Subsection A.1 of the Freedom of Information Act. <br />Mayor Wright ruled that the discussion to appoint a Vice Mayor would be <br />discussed in open session and the discussion of appointments to Council would be <br />discussed in closed session. <br />Dr. Whitaker raised a point of order that the motion to go into closed session to <br />discuss Council appointments did not fall under Subsection A.1. <br />Mayor Wright ruled that the discussion to appoint a Vice Mayor and the <br />discussion of appointments to Council would be discussed in open session. <br />Motion by Ms. Psimas, and seconded by Mr. Meeks, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711 of the Code of Virginia for the purpose of the <br />following: <br />Consultation with legal counsel pertaining to actual litigation (Funkhouser, et al. <br />v. City), as permitted under Subsection A.1. <br />The motion was adopted by the following vote: <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br />Motion by Ms. Psimas, and seconded by Mr. Meeks, pursuant to Section 2.2- <br />3712(D) of the Code of Virginia, certifying that to the best of the Council Member's <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br />
