December 9, 2014 <br />(b) The development shall generally conform to the conceptual site plans titled D- <br />ORDER# 76276.05, dated July 3, 2014 and prepared by Cummings Resources, LLC <br />and 7- Eleven Store No. 37129, dated September 8, 2014 and prepared by Cummings <br />Resources, LLC and 7- Eleven Store No. 37129, dated September 8, 2014 and prepared <br />by K2M Design, subject to modifications required during the site plan review and <br />approval process. <br />(c) The development shall comply with the requirements set forth in Section 40.1 - <br />4.3(C)(9)(c)(i) -(vii) of the Code of the City of Portsmouth, Virginia (2006) ( "Gasoline <br />Sales "). <br />(d) A Traffic Impact Study shall be performed and the conclusions and <br />recommendations identified in the Traffic Impact Study shall be implemented to address <br />site access and circulation. <br />(e) The site shall be developed and operated in compliance with all applicable local, <br />state and federal laws and regulations and any required operating licenses shall be <br />obtained and maintained. <br />(f) All taxes /fees associated with the property and the use shall be paid when due. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by City Council." <br />Ayes: Cherry, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />- Other Unfinished Business - <br />14 - 407 - Code amendment: <br />1. Glenna Cornett, 201 Thelmar Lane, spoke in opposition to the proposed prohibition <br />of the storage of construction equipment on residential lots. <br />2. Donna Sayegh, 3104 Garland Drive, spoke in Principles of Liberty #14 <br />3. Mark Geduldig - Yatrofsky, P. O. Box 50141, asked that City Council defer this item <br />again for further review and to receive additional input from the community. <br />14 -407: <br />Motion by Ms. Psimas, and seconded by Mr. Moody, to approve Item 14 -407 with <br />the exception of Amendment 24 for discussion purposes. <br />After discussion, the motion to approve Item 14 -407 with the exception of <br />Amendment 24 was withdrawn by Ms. Psimas and Mr. Moody. <br />Motion by Mr. Meeks, and seconded by Mr. Cherry, to adopt the following <br />ordinance and was adopted by the following vote: <br />"ORDINANCE TO AMEND CHAPTER 40.1 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) PERTAINING TO ZONING." <br />Ayes: Cherry, Meeks, Psimas, Randall, Wright <br />Nays: Moody <br />- City Manager's Report - <br />14 - 468 - Adoption of an ordinance appropriating $40,325,841 by classification to <br />the FY 2014 -15 Operating Budget for the Portsmouth Public School System to <br />implement the Third Quarter of the Approved Operating Budget.
