October 28, 2014 <br />2. That 7-Eleven, Inc. is hereby granted a use permit pursuant to Section <br />40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to construct a <br />convenience store with gasoline sales at 3500 Victory Boulevard, Portsmouth, Virginia, <br />and being more particularly described as: <br />UP-14-14 <br />3500 Victory Boulevard <br />ALL THAT certain parcel of land with the buildings and improvements thereon, lying, <br />situate and being in the City of Portsmouth, State of Virginia, and more particularly <br />bounded and described as follows: <br />BEGINNING at a point in the westerly right of way line of Greenwood Drive at its <br />intersection with Victory Boulevard and running N 24 degrees 32' 59" W along the <br />northerly right of way line of Victory Boulevard a distance of 175 feet to a point; <br />THENCE, running N 64 degrees 5' 20" E a distance of 150 feet to a point; THENCE, <br />running S 24 degrees 32' 43" E a distance of 175 feet to a point in the westerly right of <br />way of Greenwood Drive; THENCE running in a southwesterly direction along the <br />westerly right of way line of Greenwood Drive a distance of 150 feet to the point of <br />beginning. <br />BEING the same property conveyed to Nine - T-9, L.L.C. by Deed of Gift from Sun K. <br />Smith f/k/a Sun K. Ward dated March 6, 2002 and recorded in the Portsmouth Circuit <br />Court Clerk's Office as Instrument Number 022383. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development of the site shall be in substantial conformity with the concept <br />plan titled Victory & Greenwood Concept Plan for 7-Eleven prepared by Blakeway Corp. <br />and dated August 18, 2014 and the Perspective and Fueling Canopy Elevations <br />prepared by I<2M Design dated June 18, 2014, except as may be necessary to comply <br />with any modifications required by City Ordinances and the City Code during site plan <br />review and approval. <br />(b) The applicant must obtain and keep current any required operating licenses and <br />shall operate in accordance with all applicable codes, ordinances, and regulations of <br />federal, state and local governments. <br />(c) All taxes/fees in connection with the property and the use shall be paid when <br />due. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by City Council." <br />Ayes: Cherry, Meeks, Moody, Psimas, Randall, Wright <br />Nays: Edmonds <br />- City Manager's Report - <br />14 - 408 -Adoption of an ordinance appropriating a supplemental budget <br />allocation from the Virginia Department of Social Services in the amount of <br />$47,115 and appropriating said funds in the FY 2014-15 Social Services Fund for <br />use by the Department of Social Services to fund compensation for personnel to <br />processing Medicaid renewal applications.
