September 23, 2014 <br />WHEREAS, in exchange for EPA and DEQ consenting to the modifications, the City will <br />be required to agree to: (1) perform certain operation and maintenance activities on the <br />Properties until they are conveyed for development; and (2) reimburse DEQ $200,000 <br />when the Properties are sold for development but in any event no later than January <br />2029 (the "City Obligations"); and <br />WHEREAS, the Portsmouth Port and Industrial Commission ("PPIC") is best <br />situated to market the Properties for industrial and/or maritime development; <br />WHEREAS, the City has previously passed a resolution to convey its portion of <br />the Properties to PPIC and has requested the School Board to convey the remaining <br />area of the Properties to PPIC; and <br />WHEREAS, a Memorandum of Understanding has been prepared to <br />memorialize the respective obligations of the City and PPIC with respect to the <br />Properties; and <br />WHEREAS, the City may be required to execute certain additional documents or <br />agreements with PPIC and DEQ and/or EPA memorializing the City Obligations; <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that the City Manager is hereby authorized to execute a Memorandum of <br />Agreement with PPIC and such other agreements with PPIC, EPA and/or DEQ as may <br />be necessary or desirable to memorialize the City Obligations and induce EPA and <br />DEQ to modify the Remedial Action Plan or other remedial plans for the Atlantic Wood <br />Industries Superfund Site." <br />Ayes: Cherry, Edmonds, Moody, Psimas, Randall, Wright <br />Nays: None <br />- New Business - <br />14 - 373 -Boards and Commissions <br />There were no appointments. <br />14 - 374 -Items Submitted by Council Members <br />- Mayor Wright spoke on the following events: <br />- Birthday celebrations for Charlie Harrell and Vernon Crump. <br />- Upcoming Fish Bowl parade, Saturday, September 27, 2014 at 10 a.m. <br />- Congratulated Michelle Williams on being elected Fish Bowl Queen. <br />14 - 375 -Report on Pending Items <br />• There were no pending items. <br />14 - 376 -Non-Agenda Speakers <br />1. Terry Danaher, 413 Dinwiddie Street, informed citizens and City Council of upcoming <br />Coast Guard celebration, Saturday, October 4 from noon 5 p.m. She also voiced <br />her concern with the toll billing problems. <br />2. Bettie Ashberry, 5218 Cobble Hill Road, voiced her concern with the City Council's <br />decision to retain the City Auditor. <br />3. AI Holmes, 115 Keeper Street, asked that City Council ensure that the developers of <br />the First Watch neighborhood complete the necessary work that was proffered to <br />the City. <br />4. Elvira Johnson, 3313 Armstead Drive, voiced her concern with the lack of <br />communication by staff with regards to The Pines. <br />
