August 26, 2014 <br />At a Regular Meeting of the City Council on Tuesday, August 26, 2014, there <br />were present: <br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene <br />W. Randall, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City Manager John L. Rowe, <br />Jr., City Attorney George M. Willson. <br />Reverend Charles Smith opened the meeting with prayer, which was followed by <br />the Pledge of Allegiance to the Flag. <br />Mayor Wright called the meeting to order and welcomed all in attendance. <br />Motion by Mr. Moody, and seconded by Ms. Randall, to approve the minutes of a <br />Called Meeting of August 11, 2014, of a Called Meeting of August 12, 2014, of a <br />Regular Meeting of August 12, 2014, and was adopted by the following vote: <br />Ayes: Cherry, Edmonds, Meeks, Moody, Randall, Wright <br />Nays: None <br />- Unfinished Business - <br />14 - 290 -Use permit: <br />Motion by Mr. Cherry, and seconded by Mr. Edmonds, to adopt the following <br />resolution approved on first reading at the August 12, 2014 meeting, and was adopted <br />by the following vote: <br />14-290 (a): <br />"RESOLUTION GRANTING A USE PERMIT (UP-14-10) TO MIND POWER <br />ENTERPRISE, INC., TO ESTABLISH A CIVIC LODGE AND YOUTH CLUB FACILITY <br />AT 3801 KING STREET. <br />WHEREAS, Mind Power Enterprise, Inc., the contract purchaser of the subject <br />property, has made application pursuant to Section 40.1-2.3B of the Code of the City of <br />Portsmouth, Virginia (2006) for the granting of a use permit to establish a Civic Lodge <br />and Youth Club Facility at 3801 King Street; and <br />WHEREAS, DWM Properties, LLC, the owner of the property, has consented to <br />the filing of the application; and <br />WHEREAS, the applicants and the Planning Director have done all things <br />required to be done in connection with said application; and <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />1. That it finds that the use for which the permit is sought: <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br />(b) Is consistent with the comprehensive plan; <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the zoning district(s) of surrounding lands; <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br />
