August 12, 2014 <br />1. Betty Ashberry, 5218 Cobblehhill Road, spoke in support of this item. <br />2. Steve Carroll, 3112 Riveredge Drive, spoke in opposition to this item. <br />3. Mark Geduldig-Yatrofsky, P. O. Box 50141, spoke in support of this item but voiced <br />his concern with using the fund balance. <br />Motion by Ms. Psimas, and seconded by Mr. Meeks, to adopt the following <br />ordinance, and was adopted by the following vote: <br />"ORDINANCE TO APPROPRIATE $2,850,000 FROM THE FY 2014-15 UNASSIGNED <br />FUND BALANCE TO THE FY 2014-15 GENERAL FUND, TO TRANSFER $2,850,000 <br />FROM THE FY 2014-15 GENERAL FUND TO THE FY 2014-15 CAPITAL <br />IMPROVEMENT FUND, AND TO APPROPRIATE $2,850,000 IN THE FY 2014-15 <br />CAPITAL IMPROVEMENT FUND FOR THE PURCHASE OF 801 WATER STREET <br />AND IMPROVEMENTS THEREON AND TO AUTHORIZE THE CITY MANAGER TO <br />EXECUTE THE NECESSARY LEGAL DOCUMENTS TO COMPLETE THE <br />PURCHASE." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 298 -Adoption of a resolution approving amendments to and restatements <br />of the Creation Agreement and the Service Agreement of the Hampton Roads <br />Regional Jail Authority to permit membership expansion to include the City of <br />Chesapeake. Vision Principle: A Robust Economy for Working Men and <br />Women. <br />Background: <br />• The HRRJ was created December 14, 1993, with Hampton, Newport News, <br />Norfolk and Portsmouth as member cities. <br />• The Initial Creation Agreement dated December 14, 1993 established the <br />regional jail as an Authority. <br />• The Initial Service Agreement dated December 1, 1995 set out the rights and <br />responsibilities of the respective members as to the operation of the Regional Jail. <br />• Each member must approve amendments the Creation and Service Agreements <br />to allow for expansion of membership to include the City of Chesapeake. These <br />amendments must be approved by both the HRRJ Board and respective City Council of <br />each member. <br />• The HRRJ Board voted for approval on June 18, 2014 and July 24, 2014. <br />Discussion: <br />• Chesapeake will become a full member of the Authority with all rights and <br />responsibilities. <br />• Chesapeake's initial guaranteed capacity is 250 beds. Chesapeake began <br />paying for fifty beds on July 1, 2014, and will increase its payments in 25-bed <br />increments quarterly until its pays for its full 250 guaranteed capacity on July 1, 2016. <br />• Chesapeake will pay $3 million to the Authority to buy into its membership in <br />three increments; it will pay $1 million by October 1, 2014, $1 million by July 1, 2015, <br />and $1 million by July 1, 2016. <br />• Chesapeake's final approval of the Agreement by their City Council will occur in <br />September 2014, after all the initial member cities approve the agreements. <br />Financial Impact: <br />• Chesapeake's membership is already factored into the FY2015 HRRJ budget. <br />No additional actions are necessary. <br />Recommended Action: <br />• Adoption of the Resolution.
