<br />At a Regular Meeting of the City Council on Tuesday, February 25, 2014, there
<br />were present:
<br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene
<br />W. Randall, Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks., City
<br />Manager John L. Rowe, Jr., Deputy City Attorney Cheran Cordell.
<br />Pastor Tom Potter opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />Mayor Wright called the meeting to order and welcomed all in attendance.
<br />Motion by Mr. Edmonds, and seconded by Mr. Meeks, to approve the minutes of
<br />a Called Meeting of February 10, 2014, of a Called Meeting of February 11, 2014, of a
<br />Regular Meeting of February 11, 2014, and of a Called Meeting of February 18, 2014,
<br />and was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright
<br />Nays: None
<br />- Unfinished Business -
<br />14 - 38 -Use permit:
<br />Motion by Ms. Randall, and seconded by Mr. Meeks, to adopt the following
<br />resolution approved on first reading at the February 11, 2014 meeting, and was adopted
<br />by the following vote:
<br />14-38:
<br />"RESOLUTION GRANTING A USE PERMIT (UP-14-01) TO HOLIDAY HOUSE OF
<br />PORTSMOUTH, INC., TO CONSTRUCT A RECREATION CENTER AT 4211
<br />COUNTY STREET.
<br />WHEREAS, Holiday House of Portsmouth, Inc., has made application pursuant
<br />to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to amend a
<br />previously-issued use permit (UP-09-01) to permit the construction of a recreation
<br />center for its residents at 4211 County Street; and
<br />WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />WHEREAS, the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
<br />1. That it finds that the use for which the permit is sought:
<br />(a) Complies with the applicable standards of the Zoning Ordinance;
<br />(b) Is consistent with the comprehensive plan;
<br />(c) Is compatible with the character of surrounding lands and the uses permitted in
<br />the subject property's zoning district;
<br />(d) Is configured to minimize adverse effects, including the visual impacts of the
<br />proposed use on adjacent lands;
<br />(e) Avoids significant deterioration of water and air resources, and other natural
<br />resources;
