November 26, 2013 <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br />(f) Maintains safe and adequate egress and ingress onto the site and safe road <br />conditions around the site; <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in their zoning district(s); <br />(h) Complies with all other city, state, and federal laws and regulations. <br />2. That the applicant is hereby granted a use permit pursuant to Section <br />40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to allow parking in <br />excess of 175% of the required parking in conjunction with the construction of a <br />convenience store with gasoline sales on the subject property, which is more <br />particularly described as: <br />UP-13-16 <br />3601 Victory Boulevard <br />Beginning at the northwestern corner of the right-of-way at Victory Boulevard and <br />Freedom Avenue running southwesterly approximately 305 feet to the intersection of <br />Freedom Avenue and Rapidan Street; thence north 302 feet along the right-of-way of <br />Rapidan Street to a point; thence northeasterly 308 feet to a point on the right-of-way of <br />Victory Boulevard; thence 314 feet along the right-of-way of Victory Boulevard to the <br />point of beginning; and being further identified as 3601 Victory Boulevard and Tax Map <br />531, parcel 11. <br />3. That the use permit is approved subject to the following condition which <br />shall be observed by the applicant and any successor in interest: <br />The number of off-street parking spaces provided on the site, excluding spaces <br />provided at the gasoline pumps, shall be limited to 73 spaces. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br />Ayes: Cherry, Meeks, Moody, Psimas, Randall, Wright <br />Nays: Edmonds <br />13-458 (e) <br />Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following <br />resolution denied on first reading at the November 12, 2013 meeting, and was adopted <br />by the following vote: <br />"RESOLUTION GRANTING A USE PERMIT (UP-13-17) TO PATRICIA HARDY TO <br />OPERATE A FAMILY DAY CARE CENTER AT 20 APPOMATTOX AVENUE. <br />WHEREAS, Patricia Hardy has made application pursuant to Section 40.1- <br />2.3(6) of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use <br />permit for the operation of a family day care center at 20 Appomattox Avenue, <br />Portsmouth, Virginia; and <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />
