November 26, 2013 <br />At a Regular Meeting of the City Council on Tuesday, November 26, 2013, there <br />were present: <br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene <br />W. Randall, Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City <br />Manager John L. Rowe, Jr., City Attorney George M. Willson. <br />Reverend Johnnie Drake opened the meeting with prayer, which was followed by <br />the Pledge of Allegiance to the Flag. <br />Mayor Wright called the meeting to order and welcomed all in attendance. <br />Motion by Mr. Edmonds, and seconded by Mr. Moody, to approve the minutes of <br />a Called Meeting of November 12, 2013, and of a Regular Meeting of November 12, <br />2013, and was adopted by the following vote: <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />13 - 480 -Presentation: <br />• Presentation of proclamation to Father John Agbaje. <br />- Unfinished Business - <br />Consent Agenda: <br />13 - 458 -Use permits: <br />Motion by Mr. Meeks, and seconded by Ms. Randall, to adopt the following <br />resolutions approved on first reading at the November 12, 2013 meeting, and was <br />adopted by the following vote: <br />13-458 (a) <br />"RESOLUTION GRANTING A USE PERMIT (UP-13-13) TO TIMMONS GROUP TO <br />CONSTRUCT AFIVE-STORY BUILDING CONTAINING 1APPROXIMATELY 123, 000 <br />SQUARE FEET AND 134 DWELLING UNITS AT 800 AND 805 CRAWFORD <br />STREET. <br />WHEREAS, Timmons Group, contract purchaser of 800 and 805 Crawford <br />Street, has made application pursuant to Section 40.1-2.3(B) of the Code of the City of <br />Portsmouth, Virginia (2006) for the granting of a use permit to construct a mixed use <br />residential and office building on said property; and <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />1. That it finds that the use for which the permit is sought: <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br />(b) Is consistent with the comprehensive plan; <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the subject property's zoning district; <br />
