November 26, 2013 At a Regular Meeting of the City Council on Tuesday, November 26, 2013, there were present: Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene W. Randall, Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City Manager John L. Rowe, Jr., City Attorney George M. Willson. Reverend Johnnie Drake opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Wright called the meeting to order and welcomed all in attendance. Motion by Mr. Edmonds, and seconded by Mr. Moody, to approve the minutes of a Called Meeting of November 12, 2013, and of a Regular Meeting of November 12, 2013, and was adopted by the following vote: Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright Nays: None 13 - 480 -Presentation: • Presentation of proclamation to Father John Agbaje. - Unfinished Business - Consent Agenda: 13 - 458 -Use permits: Motion by Mr. Meeks, and seconded by Ms. Randall, to adopt the following resolutions approved on first reading at the November 12, 2013 meeting, and was adopted by the following vote: 13-458 (a) "RESOLUTION GRANTING A USE PERMIT (UP-13-13) TO TIMMONS GROUP TO CONSTRUCT AFIVE-STORY BUILDING CONTAINING 1APPROXIMATELY 123, 000 SQUARE FEET AND 134 DWELLING UNITS AT 800 AND 805 CRAWFORD STREET. WHEREAS, Timmons Group, contract purchaser of 800 and 805 Crawford Street, has made application pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit to construct a mixed use residential and office building on said property; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Complies with the applicable standards of the Zoning Ordinance; (b) Is consistent with the comprehensive plan; (c) Is compatible with the character of surrounding lands and the uses permitted in the subject property's zoning district;
