REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />- City Manager's Report - <br />13 - 481 -Adoption of an ordinance (a) accepting a grant in the amount of <br />$168,550 from the Virginia Land and Water Conservation Fund and appropriating <br />the grant funds in the FY 2013-14 Grants Fund, (b) authorizing the execution of a <br />Project Agreement with the Virginia Department of Conservation and Recreation <br />for use of the grant funds, and (c) appropriating an additional $168,550 from the <br />Elizabeth River Project in the FY 2013-14 Capital Improvement Fund to be used <br />for the Paradise Creek Nature Park. Vision Principle: Bold New Directions; <br />Neighborhoods and a Sense of Community; Lifelong Learning Community. <br />Background: <br />• ERP is beginning its second phase of capital improvements to Paradise Creek <br />Nature Park. In accordance with its Agreement with the City of Portsmouth as amended <br />August 23, 2011, ERP will transfer ownership of the Park to the City after completing <br />the second phase of improvements in 2015. <br />• In addition, the City began maintaining the Park and its Phase I improvements <br />on December 31, 2012. <br />• On January 8, 2013, City Council authorized the City Manager to apply for the <br />LWCF grant administered by DCR for certain capital improvements at Paradise Creek <br />Nature Park. <br />• On August 13, 2013, DCR notified the City that had been awarded the LWCF <br />Grant. <br />Discussion: <br />• ERP and the City have planned capital improvements in Phase II which are <br />eligible for 50% funding by LWCF. These include the kayak canoe launch, the pervious <br />parking lot expansion, and the pavilion, totaling $337,100. <br />• The ordinance appropriates the full amount of the project cost ($337,100) in the <br />Grants and CIP Funds (50/50). The Portsmouth Department of Parks, Recreation & <br />Leisure Services will manage the project, including procurement, inspection, and <br />payment authorization for all contract work. After it makes each progress payment, the <br />City will seek reimbursement from DCR for its 50% share of project costs and <br />reimbursement from ERP for its 50% share of project costs. <br />• By executing the Project Agreement with DCR, the City Manager will accept the <br />LWCF grant funds, and will agree to comply with the terms and conditions for project <br />compliance and grant reimbursement. <br />Financial Impact: <br />• The City will pay for all project expenses up to $337,100 and will be reimbursed <br />for 100% of project expenses as follows: 50% ($168,550) will be reimbursed by the <br />LWCF grant; 50% ($168,550) will be reimbursed by ERP. <br />Staff Recommends: <br />• Adoption of the ordinance and authorization for the City Manager to execute the <br />LWCF Project Agreement with DCR.
