November 12, 2013 At a Called Meeting of the City Council on Tuesday, November 12, 2013, there were present: Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., *Marlene W. Randall, *Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., *Danny W. Meeks, City Manager John L. Rowe, Jr., City Attorney George M. Willson. 13 - 455 -The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the 6t" Floor Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, November 12, 2013 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 13 - 456 -The following items were discussed in Public Work Session: 1. African American Library -Brannon Godfrey, Deputy City Manager 2. One-time Funding for emergency Winter Shelter-Homeless -John Rowe, City Manager 13 - 457 -Motion by Mr. Moody, and seconded by Mr. Edmonds, to go into Closed Meeting pursuant to provisions of Section 2.2-3711 of the Code of Virginia, for the following purposes: - Consultation with legal counsel and briefing by staff pertaining to a matter of actual litigation (Meeks v. City of Portsmouth), as permitted under Subsection A.7; - Consultation with legal counsel and briefings by staff regarding legal matters involving; 1. Restrictive covenants applicable to the Ocean Marine site, 2. An appeal from a decision of the Historic Preservation Commission, and 3. City property and the MLK Connector project all as permitted under Subsection A.7. - Discussion concerning the performance of the City Council members, as permitted under Subsection A.1. The motion was adopted by the following vote: Ayes: Cherry, Edmonds, Moody, Randall, Wright Nays: None Motion by Mr. Moody, and seconded by Mr. Edmonds, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
