November 12, 2013 <br />At a Called Meeting of the City Council on Tuesday, November 12, 2013, there <br />were present: <br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., *Marlene <br />W. Randall, *Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., *Danny W. Meeks, City <br />Manager John L. Rowe, Jr., City Attorney George M. Willson. <br />13 - 455 -The following call for the meeting was read: <br />"Please attend a Called Meeting of the City Council to be held in the 6t" Floor <br />Conference Room, 801 Crawford Street, 5:00 p.m., Tuesday, November 12, 2013 for <br />the purpose of a Public Work Session. <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />13 - 456 -The following items were discussed in Public Work Session: <br />1. African American Library -Brannon Godfrey, Deputy City Manager <br />2. One-time Funding for emergency Winter Shelter-Homeless -John Rowe, City <br />Manager <br />13 - 457 -Motion by Mr. Moody, and seconded by Mr. Edmonds, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711 of the Code of Virginia, for the <br />following purposes: <br />- Consultation with legal counsel and briefing by staff pertaining to a matter of <br />actual litigation (Meeks v. City of Portsmouth), as permitted under Subsection <br />A.7; <br />- Consultation with legal counsel and briefings by staff regarding legal matters <br />involving; <br />1. Restrictive covenants applicable to the Ocean Marine site, <br />2. An appeal from a decision of the Historic Preservation Commission, and <br />3. City property and the MLK Connector project <br />all as permitted under Subsection A.7. <br />- Discussion concerning the performance of the City Council members, as <br />permitted under Subsection A.1. <br />The motion was adopted by the following vote: <br />Ayes: Cherry, Edmonds, Moody, Randall, Wright <br />Nays: None <br />Motion by Mr. Moody, and seconded by Mr. Edmonds, pursuant to Section 2.2- <br />3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br />1. Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br />The motion was adopted by the following vote: <br />
