<br />At a Regular Meeting of the City Council on Tuesday, September 24, 2013, there
<br />were present:
<br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene
<br />W. Randall, Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City
<br />Manager John L. Rowe, Jr., City Attorney George M. Willson.
<br />Elder Michael Porter opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />Mayor Wright called the meeting to order and welcomed all in attendance.
<br />Motion by Mr. Edmonds, and seconded by Ms. Randall, to approve the minutes
<br />of a Called Meeting of September 9, 2013, of a Called Meeting of September 10, 2013,
<br />of a Regular Meeting of September 10, 2013, and of a Called Meeting September 16,
<br />2013, and was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright
<br />Nays: None

<br />Consent Agenda:
<br />13 - 377 -Use permit:
<br />Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following
<br />resolutions approved on first reading at the September 10, 2013 meeting, and was
<br />adopted by the following vote:
<br />13-377 (a)
<br />"RESOLUTION GRANTING A USE PERMIT (UP-13-10) FOR THE OPERATION OF
<br />AN ENTERTAINMENT ESTABLISHMENT AT 6041 HIGH STREET.
<br />WHEREAS, Alice Amory, owner of Amory's Seafood II, has made application
<br />pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006)
<br />for the granting of a use permit to operate an entertainment establishment at 6041 High
<br />Street, Portsmouth, Virginia; and
<br />WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />WHEREAS, the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
<br />1. That it finds that the use for which the permit is sought:
<br />(a) Complies with the applicable standards of the Zoning Ordinance;
<br />(b) Is consistent with the comprehensive plan;
<br />(c) Is compatible with the character of surrounding lands and the uses permitted in
<br />the subject property's zoning district;
<br />(d) Is configured to minimize adverse effects, including the visual impacts of the
<br />proposed use on adjacent lands;
<br />(e) Avoids significant deterioration of water and air resources, and other natural
<br />resources;
