September 24, 2013 <br />BE IT FURTHER RESOLVED that the City's application for project funding under <br />the Virginia Department of Transportation's Transportation Alternatives Program is <br />approved, and that City Manager is directed to make application and take all other <br />actions necessary for funding under said Program." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />13 - 405 -Adoption of a resolution authorizing the City Manager to execute a Deed <br />of Conveyance to the Virginia Port Authority for Lot 216 in Pinners Point. Vision <br />Principle: Leading Maritime Center. <br />Background: <br />• In 2006, the City of Portsmouth attempted to convey to the Virginia Port Authority <br />(VPA) all City property in the Pinners Point terminal area as required by agreement <br />between the City and the Port Authority in the late 1970's. <br />• The Port Authority has recently determined that Lot 216 on the Plat of Pinners <br />Point Land Company was not conveyed and remains in the name of the City. <br />• VPA is reviewing its title to the Pinners Point facility as it prepares to lease all or <br />a portion of it to private entities. <br />• The lot to be conveyed to the Port Authority has been in use as part of the <br />Pinners Point terminal since the late 1970's and is part of the existing roadway access <br />to the Midtown Tunnel. <br />• The conveyance of this property by the City is in compliance with agreements <br />between the City and the Port Authority. <br />Discussion: <br />• Conveyance of the property will resolve a title issue for VPA and allow it to lease <br />the property if necessary. <br />• The City has no need for the property which should have been conveyed to VPA <br />in the 1970's. <br />Financial Impact: <br />• None. The City's conveyance of this property is without compensation in <br />accordance with the original agreement with the Port Authority. <br />Staff Recommends: <br />• Adoption of a Resolution authorizing the City Manager to execute a Deed and <br />other instruments necessary to convey Lot 216 on the Plat of the Pinners Point Land <br />Company to the Virginia Port Authority. Vision Principle: Leading Maritime Center. <br />Next Steps following City Council Action: <br />• The City Attorney's Office will prepare and the Deed of Conveyance and any <br />other necessary documents for execution by the City Manager. <br />Motion by Ms. Randall, and seconded by Ms. Psimas, to adopt the following <br />resolution, and was adopted by the following vote: <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br />CONVEYANCE TO THE VIRGINIA PORT AUTHORITY FOR LOT 216 IN PINNERS <br />POINT. <br />WHEREAS, in the 1970's and again in 2006, the City attempted to convey title to <br />the Virginia Port Authority of all City-owned properties in Pinners Point; and <br />WHEREAS, Lot 216 on the Plat of Pinners Point Land Company was not <br />conveyed and remains in the name of the City; and <br />WHEREAS, the City has no need for continued ownership of Lot 216 which <br />should have been conveyed to VPA previously. <br />
