September 24, 2013 BE IT FURTHER RESOLVED that the City's application for project funding under the Virginia Department of Transportation's Transportation Alternatives Program is approved, and that City Manager is directed to make application and take all other actions necessary for funding under said Program." Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright Nays: None 13 - 405 -Adoption of a resolution authorizing the City Manager to execute a Deed of Conveyance to the Virginia Port Authority for Lot 216 in Pinners Point. Vision Principle: Leading Maritime Center. Background: • In 2006, the City of Portsmouth attempted to convey to the Virginia Port Authority (VPA) all City property in the Pinners Point terminal area as required by agreement between the City and the Port Authority in the late 1970's. • The Port Authority has recently determined that Lot 216 on the Plat of Pinners Point Land Company was not conveyed and remains in the name of the City. • VPA is reviewing its title to the Pinners Point facility as it prepares to lease all or a portion of it to private entities. • The lot to be conveyed to the Port Authority has been in use as part of the Pinners Point terminal since the late 1970's and is part of the existing roadway access to the Midtown Tunnel. • The conveyance of this property by the City is in compliance with agreements between the City and the Port Authority. Discussion: • Conveyance of the property will resolve a title issue for VPA and allow it to lease the property if necessary. • The City has no need for the property which should have been conveyed to VPA in the 1970's. Financial Impact: • None. The City's conveyance of this property is without compensation in accordance with the original agreement with the Port Authority. Staff Recommends: • Adoption of a Resolution authorizing the City Manager to execute a Deed and other instruments necessary to convey Lot 216 on the Plat of the Pinners Point Land Company to the Virginia Port Authority. Next Steps following City Council Action: • The City Attorney's Office will prepare and the Deed of Conveyance and any other necessary documents for execution by the City Manager. Motion by Ms. Randall, and seconded by Ms. Psimas, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF CONVEYANCE TO THE VIRGINIA PORT AUTHORITY FOR LOT 216 IN PINNERS POINT. WHEREAS, in the 1970's and again in 2006, the City attempted to convey title to the Virginia Port Authority of all City-owned properties in Pinners Point; and WHEREAS, Lot 216 on the Plat of Pinners Point Land Company was not conveyed and remains in the name of the City; and WHEREAS, the City has no need for continued ownership of Lot 216 which should have been conveyed to VPA previously.
