July 23, 2013 <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br />(f) Maintains safe and adequate egress and ingress onto the site and safe road <br />conditions around the site; <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in their zoning district(s); <br />(h) Complies with all other city, state, and federal laws and regulations. <br />2. That Quarles Petroleum is hereby granted a use permit pursuant to Section <br />40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the installation of <br />replacement signage at 2401 Turnpike Road, Portsmouth, Virginia, and being more <br />particularly described as: <br />U P-13-06 <br />2401 Turnpike Road <br />Beginning at the northwest corner of the intersection of Confederate Avenue and <br />Turnpike Road, then running north for a distance of 187 feet along the right-of-way of <br />Confederate Avenue, then running west for 264 feet, then running south for 340 feet <br />along the CSX Railroad right-of-way, then running northeast for 298 feet to the point of <br />beginning. This property is addressed as 2401 Turnpike Road and is also described as <br />Tax Map 456, Parcel 6. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The proposed signage shall adhere to the location, height and dimensional <br />specifications set out in the applicant's contract with Interstate Sign Company, a copy of <br />which is attached hereto as Exhibit A and made a part hereof. <br />(b) Landscaping shall be replaced at the base of the new sign, to consist of bushes 3 <br />feet on center as approved by the Director of Planning. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br />13-288 (b) <br />"RESOLUTION GRANTING A USE PERMIT (UP-13-07) TO MT. CARMEL <br />MISSIONARY BAPTIST CHURCH TO OPERATE A CHILD DAY CARE CENTER AT <br />3310 DEEP CREEK BOULEVARD AND 17-27 MANLY STREET. <br />WHEREAS, Mt. Carmel Missionary Baptist Church has made application <br />pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for <br />the granting of a use permit for the operation of a child day care center at 3310 Deep <br />Creek Boulevard and 17-27 Manly Street, Portsmouth, Virginia; and <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />
