<br />At a Regular Meeting of the City Council on Tuesday, May 28, 2013, there were
<br />present:
<br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Elizabeth
<br />M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City Manager John L. Rowe,
<br />City Attorney George M. Willson.
<br />Pastor Felton Whitfield opened the meeting with prayer, which was followed by
<br />the Pledge of Allegiance to the Flag.
<br />Mayor Wright called the meeting to order and welcomed all in attendance.
<br />Motion by Mr. Moody, and seconded by Ms. Psimas, to approve the minutes of a
<br />Called Meeting of May 13, 2013, of a Called Meeting of May 14, 2013, and of a Regular
<br />Meeting of May 14, 2013, and was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Wright
<br />Nays: None
<br />- Public Hearing -
<br />13 - 221 -Public hearing on code amendment application:
<br />(a) CA-13-01 In accordance with a resolution adopted by City Council, the City
<br />of Portsmouth is proposing amendments to Section 40.1-4.4 of the City of
<br />Portsmouth Zoning ordinance to allow the keeping of a limited number of
<br />chickens as an accessory use to a detached single family residence under
<br />certain conditions and requirements. Vision Principle: Change and New
<br />Direction.
<br />1. Ruth Goodhart, 4805 Templar Drive, spoke in support to this item.
<br />2. Kathy Shapley, 116 Byers Avenue, spoke in support to this item.
<br />3. Rebecca Hersey, 3905 Turnpike Road, spoke in support to this item.
<br />Motion by Mr. Moody, and seconded by Ms. Psimas to concur with the
<br />recommendation of the Planning Commission that CA-13-01 be approved, with the
<br />requirement that in addition to staff issuing a permit, they must also notify by letter, all
<br />the adjoining property owners advising them that someone has obtained a permit that
<br />allows them to have chickens and what the standards would be to keep those chickens,
<br />and was adopted by the following vote:

<br />- City Manager's Report -
<br />13 - 222 -Adoption of an ordinance to amend Chapter 16 of the Code of the City
<br />of Portsmouth, Virginia 2006) by amending Sections 16-1, 16-9, 16-32, 16-33 and
<br />16-36 thereof pertaining to garbage and refuse. Vision Principle: Efficient,
<br />Responsive Government.
<br />Background:
<br />• On March 11, 2013, City Staff presented to City Council at the Public Works
<br />Session "A Comprehensive Recycling Program."
<br />• On March 26, 2013, City Council approved an ordinance to appropriate funds for
<br />purchase of the 35,000 recycling carts and three collection vehicles.
<br />• Minor changes need to be made to Chapter 16- Garbage and Refuse to add
<br />language for the addition of collection of recyclables.
