March 26, 2013 <br />At a Regular Meeting of the City Council on Tuesday, March 26, 2013, there <br />were present: <br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene <br />W. Randall, Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City <br />Manager John L. Rowe, Jr., City Attorney George M. Willson. <br />Reverend Johnnie Drake, opened the meeting with prayer, which was followed <br />by the Pledge of Allegiance to the Flag. <br />Mayor Wright called the meeting to order and welcomed all in attendance. <br />Motion by Mr. Moody, and seconded by Ms. Randall, to approve the minutes of a <br />Called Meeting of March 11, 2013, of a Called Meeting of March 12, 2013, and of a <br />Regular Meeting of March 12, 2013, and was adopted by the following vote: <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />- Unfinished Business - <br />13 - 111 -Use permits: <br />13-111 (a): <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, asked that Council members state their <br />reasons for voting against an item on the agenda. <br />Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following <br />ordinance approved on first reading at the March 12, 2013 meeting, and was adopted <br />by the following vote: <br />"ZONING AMENDMENT ORDINANCE Z-13-01." <br />Ayes: Cherry, Moody, Psimas, Randall, Wright <br />Nays: Edmonds <br />(Councilman Meeks excused himself from voting on Item 13-111(a) because of <br />financial interest and left the Council Chamber prior to any consideration of the item.) <br />Consent Agenda: <br />13 - 111 -Use permit: <br />Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following <br />resolutions approved on first reading at the March 12, 2013 meeting, and was adopted <br />by the following vote: <br />13-111 (b) <br />"RESOLUTION GRANTING A USE PERMIT (UP-13-02) TO KROGER LIMITED <br />PARTNERSHIP I, TO CONSTRUCT A LARGE RETAIL DEVELOPMENT (SINGLE <br />TENANT BUILDING) AT 2900 TURNPIKE ROAD. <br />WHEREAS, Kroger Limited Partnership I, contract purchaser of the subject <br />property, has made application pursuant to Section 40.1-2.3B of the Code of the City of <br />Portsmouth, Virginia (2006) for the granting of a use permit to construct a Large Retail <br />Development (Single Tenant Building) at 2900 Turnpike Road, Portsmouth, Virginia; <br />and <br />WHEREAS, the Economic Development Authority of the City of Portsmouth, <br />Virginia, the owner of the property, has consented to the filing of the application; and <br />
