January 22, 2013 <br />(k) The owners and/or operators of the establishment shall not violate any laws of <br />the Commonwealth or ordinances of the City related to peace and good order, not suffer <br />repeated or chronic violations by any of its patrons or customers. If the Chief of Police, <br />in his discretion, determines that there are significant violations of this type to comprise <br />a significant law enforcement problem, he shall so notify the applicant in writing and <br />shall provide a copy of such notice .to the Director of Planning. If, within six months of <br />the date of such letter, the Director of Planning determines that the offenses against <br />peace and good order are continuing, then he may initiate proceedings for the <br />revocation of this permit. Provided, however, that if at any time problems exist of such a <br />severity that the Chief of Police determines that there is a significant risk to public safety <br />or peace and good order of such proportions as to create a risk of blight, revocation <br />proceedings may be initiated by the Director of Planning regardless of the six month <br />requirement. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />- City Manager's Report - <br />13 - 43 -Adoption of a resolution requesting that the General Assembly and <br />Governor accept and implement the full expansion of Medicaid as provided by the <br />federal Patient Protection and Affordable Care Act of 2010. Vision Principle: <br />Efficient, Responsive Government and Change and New Directions. <br />Background: <br />• The Patient Protection and Affordable Care Act ("the Act") is a 2010 federal law <br />which expands the availability of health care through an expansion of Medicaid. State <br />legislators have the option to authorize Medicaid expansion in their state. <br />• The expansion established a new income eligibility criterion of 133% of the <br />federal poverty level. The Act provides 100% federal funding for the expansion in the <br />first three years, after which time the federal funding will be reduced to no less than <br />90% of the cost. <br />• The State announced in December that Virginia would not participate in the <br />expansion of this program. <br />Discussion: <br />• 20,368 Portsmouth residents currently receive Medicaid benefits, but an <br />estimated 12,120 additional adult residents under the age of 65 remain uninsured. An <br />estimated additional 15,000 Portsmouth residents will be eligible for Medicaid expansion <br />under the federal law, including a significant number of single persons and couples with <br />incomes between $15,415 and $20,879, as well as certain families (depending on family <br />size) with incomes up to $53,668. <br />• A significant number of uninsured Portsmouth residents who suffer from mental <br />health or substance abuse disorders will be eligible for health care coverage through <br />Medicaid expansion. <br />• The cost of declining the Medicaid expansion option will result in a higher cost <br />($262 million) to cover 90,000 persons statewide, as compared to the cost with <br />expanded coverage of $245 million to cover 400,000 persons. <br />• If it opts to decline Medicaid expansion, the Commonwealth will have to continue <br />to reimburse hospitals for uncompensated care. Bon Secours - Hampton Roads <br />provided service to over 45,000 Medicaid patients and over 54,000 uncompensated <br />care patients in 2012. Many of the 54,000 uncompensated care patients could receive <br />Medicaid support under the extension of Medicaid as called for in the Affordable Care <br />Act. <br />• The expansion of Medicaid and the resulting infusion of new federal revenue into <br />the Virginia economy will increase local employment in medical services and supportive <br />health care industries, as well as allow low-income households to retain for <br />discretionary spending the income they would have spent on out-of-pocket medical <br />costs. <br />
