<br />At a Regular Meeting of the City Council on Tuesday, January 22, 2013, there
<br />were present:
<br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene
<br />W. Randall, Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City
<br />Manager John L. Rowe, Jr., City Attorney George M. Willson.
<br />Reverend Gregory Yancey, Sr., opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />Mayor Wright called the meeting to order and welcomed all in attendance.
<br />Motion by Mr. Moody, and seconded by Mr. Edmonds, to approve the minutes of
<br />a Called Meeting of January 8, 2013, of a Regular Meeting of January 8, 2013, and of a
<br />Called Meeting of January 15, 2013, and was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright
<br />Nays: None
<br />- Unfinished Business -
<br />13 - 22 -Use permits:
<br />13-22 (A):
<br />Motion by Ms. Psimas, and seconded by Mr. Cherry, to accept the property
<br />owner's withdrawal of Item UP-12-16, and was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright
<br />Nays: None
<br />13-22(B):
<br />Motion by Mr. Meeks, and seconded by Mr. Cherry, to adopt the following
<br />resolution considered on first reading at the January 8, 2013 meeting, and was adopted
<br />by the following vote:
<br />"RESOLUTION GRANTING A USE PERMIT TO WILLIAMS COURT II ASSOCIATES,
<br />LLC, AND MATTHEW BIRDSALL TO OPERATE AN ENTERTAINMENT
<br />ESTABLISHMENT AT 4584 GEORGE WASHINGTON HIGHWAY.
<br />WHEREAS, Matthew Birdsall, with the consent of the property owner Williams
<br />Court II Associates, LLC, has made application pursuant to Section 40.1-2.3(B) of the
<br />Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for the
<br />operation of an entertainment establishment at 4584 George Washington Highway,
<br />Portsmouth, Virginia; and
<br />WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />WHEREAS, the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
<br />1. That it finds that the use for which the permit is sought:
<br />(a) Complies with the applicable standards of the Zoning Ordinance;
<br />(b) Is consistent with the comprehensive plan;
