November 27, 2012 <br />Next Steps Following Council Action: <br />• Transmit resolution and supporting materials to a member of the City's General <br />Assembly delegation. <br />• Work with our delegation to ensure that the General Assembly adopts the <br />amended charter. <br />Motion by Mr. Moody, and seconded by Mr. Edmonds, that this item be amended <br />to delete paragraph 4, which calls for repeal of the "resign to run" provision in the <br />Portsmouth City Charter. All other items in the resolution will remain as requests to <br />amend the charter, and was adopted by the following vote: <br />"RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA TO <br />AMEND THE CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA. <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br />That the General Assembly of Virginia is hereby requested to amend the Charter <br />of the City of Portsmouth, Virginia, as follows: <br />1. Amend Section 3.02 a. (4) to provide that nominating petitions for the <br />offices of mayor and members of the city council shall not be signed prior to January 1 <br />of the year of such election, and that the petitions be filed not later than the time fixed <br />for the closing of the polls on the second Tuesday in June of the year of the election. <br />2. Amend Section 3.02 b. to provide that a candidate for the office of mayor <br />or member of the city council file his or her acceptance of such candidacy no later than <br />the time fixed for the closing of the polls on the second Tuesday in June of the year of <br />the election. <br />3. Amend Section 3.02 d. to provide that candidates for the offices of mayor <br />and city council member file the name and address of his or her campaign manager <br />with the Portsmouth Electoral Board no later than the second Tuesday in June of the <br />year of the election." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />12 - 464 -Adoption of a resolution expressing the concurrence of the Council of <br />the City of Portsmouth, Virginia with the inducement resolution adopted by the <br />Economic Development Authority of Henrico County, Virginia and approving the <br />issuance of revenue bonds for the benefit of Maryview Hospital and Bon Secours <br />Health System, Inc. Vision Principle: A Robust Economy for Working Men and <br />Women. <br />Background: <br />• Maryview Hospital ("Maryview"), is snot-for-profit Virginia nonstock corporation, <br />which is affiliated with Bon Secours Health System, Inc. ("BSHSI"), a Maryland nonstock <br />nonprofit membership corporation, and which has facilities located in the City of <br />Portsmouth, Virginia. <br />• On October 18, 2012, the Economic Development Authority of Henrico County, <br />Virginia (the "Henrico Authority") adopted an inducement resolution (the "Inducement <br />Resolution") relating to the issuance of its Revenue Bonds (Bon Secours Health <br />System, Inc.) (the "Bonds") to, among other things, (i) refund previously issued debt, (ii) <br />pay or reimburse, or refinance certain indebtedness the proceeds of which were used <br />by, Maryview for the payment of the costs of acquiring, constructing, equipping, <br />expanding, enlarging and improving certain of its medical facilities, and (iii) pay certain <br />costs incurred in connection with the issuance of the Bonds. <br />• The Bonds will be issued pursuant to the Virginia Industrial Development and <br />Revenue Bond Act, Chapter 49, Title 15.2, Code of Virginia of 1950, as amended (the <br />"Act"), and will be limited obligations of the Henrico Authority payable solely from the <br />revenues and receipts derived from payments provided by BSHSI, Maryview and <br />certain related corporations. <br />
