<br />At a Regular Meeting of the City Council on Tuesday, October 23, 2012, there
<br />were present:
<br />Mayor Kenneth I. Wright, Vice Mayor Charles B. Whitehurst, Sr., William E. Moody, Jr.,
<br />Marlene W. Randall, Stephen E. Heretick, Paige D. Cherry, Dr. Curtis E. Edmonds, Sr.,
<br />Deputy City Manager J. Brannon Godfrey, City Attorney G. Timothy Oksman.
<br />Pastor Tom Potter, opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag led by Cub Scout Pack 259.
<br />Mayor Wright called the meeting to order and welcomed all in attendance.
<br />Motion by Mr. Whitehurst, and seconded by Mr. Edmonds, to approve the
<br />minutes of a Called Meeting of October 9, 2012, and of a Regular Meeting of October 9,
<br />2012, and was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright
<br />Nays: None
<br />- Public Hearing -
<br />12-424 Public hearing on the proposed adoption of an ordinance to authorize the
<br />City to contract a debt and issue general obligation public improvement
<br />bonds (the "Bonds") of the City, or notes in anticipation thereof, in a
<br />principal amount not to exceed $3,900,000 to finance the costs of the
<br />planning, design, acquisition, construction, and equipping of various public
<br />improvement projects of the City.
<br />- Unfinished Business -
<br />12- 406 -Use permit:
<br />Motion by Mr. Heretick, and seconded by Ms. Randall, to adopt the following
<br />resolution approved on first reading at the October 9, 2012 meeting, and was adopted
<br />by the following vote:
<br />12-406:
<br />"RESOLUTION GRANTING A USE PERMIT TO DANIEL W. ASTON TO
<br />CONSTRUCT A MIXED USE BUILDING AT THE SOUTHWEST CORNER OF COURT
<br />STREET AND COUNTY STREET.
<br />WHEREAS, Daniel W. Aston, contract purchaser of the subject property has
<br />made application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth,
<br />Virginia (2006) for the granting of a use permit to construct a mixed use building at the
<br />southwest corner of Court Street and County Street, Portsmouth, Virginia; and
<br />WHEREAS, the Portsmouth Redevelopment and Housing Authority, the owner of
<br />the property, has consented to the filing of the application; and
<br />WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />WHEREAS, the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
<br />1. That it finds that the use for which the permit is sought:
<br />(a) Complies with the applicable standards of the Zoning Ordinance;
